MINUTES <br />CITY COUNCIL <br />JUNE 26, 1991 <br />Curwick also pointed out that there are several trees <br />in the area where the road is proposed to be extended. <br />One of these trees is a memorial tree for Curwick's <br />father-in-law. Curwick asked if the road easement <br />could be shifted to preserve this tree. <br />Howe reported that the tree is close to the <br />right-of-way line, and suggested that the right-of-way <br />could be shifted somewhat to save the tree. <br />The City Engineer agreed that some flexibility could be <br />allowed to save the tree. However, the Engineer <br />pointed out that he has not reviewed final plans as <br />yet. The Engineer also pointed out that the retaining <br />wall will need to be set back 5 to 6 feet from the <br />street so that there is room for snow storage on the <br />boulevard. <br />Scalze asked the height of the retaining wall. <br />Howe replied that the highest point is 3 1/2 feet. The <br />retaining wall will be constructed of decorative stone. <br />Scalze pointed out the huge retaining wall at the <br />entrance to Dianna Lane. Scalze commented that there <br />have been no problems with that wall. <br />Curwick again asked about the liability issues related <br />to the retaining wall. <br />The City Attorney replied that if the retaining wall is <br />on the City's right-of-way, the City would be sued for <br />any damages that might occur because of the wall. <br />Aowever, that issue cannot be determined at this time. <br />Curwick reported that there is a storm sewer on the <br />south end of Sunrise Drive. Curwick expressed concern <br />about the storm sewer plugging up. <br />The City Engineer replied that if the storm sewer <br />plugged, run-off would flood the intersection and then <br />spill over the curb and follow the drainage easements <br />along property lines and into the adjacent low area. <br />Curwick pointed out that there are basement windows on <br />these easement lines that are very low. <br />The City Engineer suggested that the elevations along <br />the drainage easements could be checked. If necessary, <br />the easements could be reqraded by the developer so <br />that there is positive drainage. <br />Page 10 <br />
