MINUTES <br />CITY COUNCIL <br />JUNE 26, 1991 <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (5) Blesener, LaValle, Collova, Scalze, Hanson. <br />Nays (0). <br />Resolution declared adopted. <br />Blesener pointed out that before the final plat is <br />approved, there will be a development agreement in <br />place with the developer addressing the issues of <br />landscaping, drainage, grading, utilities and access <br />over the Fasciana property. <br />The Planner noted that the Planning Commission will <br />need to review the final plat, and all submittals must <br />be made prior to Planning Commission review. <br />FINAL PLAT Mr. Gordie Howe appeared before the Council requesting <br />FREDERICKS- approval of the final plat for Frederickshaven. Howe <br />HAVEN noted that the final plat calls for the extension of <br />the Sunrise Drive cul-de-sac with five additional lots. <br />The remainder of the property is being platted as <br />Outlot A, which is set aside for future development, <br />and Outlot B, which is wetland area controlled by the <br />DNR. <br />Collova reported that Bob Barr, owner of Lot 4 on <br />Sunrise Drive, has asked that the development agreement <br />for the plat include the requirement that the developer <br />repair any damage to lots located on the existinq <br />cul-de-sac, and that these repairs be done in the fall <br />if the road is put in this year. <br />Blesener asked when the relandscaping would be <br />completed for property owners on the cul-de-sac, and <br />when would driveways be replaced. Blesener reported <br />that the property owners are worried about going over <br />the winter without driveways. <br />Howe anticipated that landscaping and driveways would <br />be completed before winter, and agreed that these <br />conditions would be addressed in the development <br />aqreement. <br />Gene Curwick, Sunrise Drive resident, had concern about <br />the elevation of the road being cut down, pointing out <br />that a retaining wall will be necessary on the <br />right-of-way. Curwick stated that if the retaining <br />wall is located on his property, he would have a <br />problem since he has concern about liability issues. <br />Curwick asked who would be liable if someone fell off <br />the retaining wall and was hurt. <br />Page 9 <br />
