MINUTES <br />CITY COUNCIL <br />JUNE 26, 1991 <br />Mr. Blesener introduced the following resolution and <br />moved its adoption: <br />RESOLUTION N0. 91-6-207 - APPROVING THE FINAL PLAT FOR <br />FREDERICKSHAVEN AS SUBMITTED CONTINGENT UPON PROPER <br />DRAINAGE AS REQUIRED BY THE CITY ENGINEER TO PROTECT <br />NEIGHBORING HOMES, CONTINGENT UPON THE DEVELOPER <br />ENTERING INTO A DEVELOPMENT AGREEMENT WITH THE CITY <br />WHICH STATES THAT LOT5 4 AND 5 WILL BE RELANDSCAPED AND <br />DRIVEWAYS REPLACED BEFORE WINTER, AND SUBJECT TO <br />PRESERVATION OF EXISTING MEMORIAL TREE, IF POSSIBLE <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (5) Blesener, LaValle, Scalze, Collova, Hanson. <br />Nays (0). <br />Resolution declared adopted. <br />The City Administrator pointed out the letter the City <br />received from a property owner regarding setbacks on <br />the existing cul-de-sac. The City Administrator <br />explained that without a vacation of the existing <br />cul-de-sac, a front yard setback variance would be <br />necessary for this particular lot. The Administrator <br />discussed the issue of the cost of the vacation <br />process. Either the developer of Frederickshaven would <br />be responsible for these costs, or the effected <br />property owners would have to initiate a petition and <br />would have to pay the costs. <br />The City Planner pointed out that once the cul-de-sac <br />is vacated, there would also be the expense of drawing <br />up new legal descriptions for the four effected <br />properties. Therefore, the Planner suqgested that the <br />City may want to wait for these property owners to <br />petition for the vacation. <br />Council directed the City Administrator to contact the <br />four property owners, identify the issue, and inform <br />them that it will be up to them to initiate for the <br />vacation of the cul-de-sac. <br />Blesener stated that as far as placinq a house along <br />the existing cul-de-sac, he would prefer to see the <br />house setback from the new road rather than the <br />oul-de-sac. <br />FINAL PLAT Mr. Bob DeBace appeared before the Council requesting <br />COSTA approval of the final plat of Phase I for Costa <br />ESTATES Estates. That involves the platting of lots along <br />DeSoto Street, with the remainder of the property to be <br />Page il <br />
