MINUTES
CITY COUNCIL
JULY 10, 1991
GATTI
RELOCATION
BENEFITS
APPEAL
The Mayor opened the public hearing to consider the
Michael Gatti and Mary Wicklander appeal for relocation
benefits.
The City Attorney reviewed his report dated May 1, 1991
regarding the application of Michael Gatti and Mary
Wicklander for relocation benefits. The Attorney
reported that in order to be eligible for relocation
benefits, the parties would have had to occupy the
premises for 90 days prior to the commencement of
condemnation action. The Attorney reported that from
the information provided by the property owner and upon
inspection by City staff, the parties did not occupy
the premises for 90 days prior to condemnation.
Therefore, it was the position of the City Attorney
that no relocation benefits are owed to either party.
There was no one present to represent either Michael
Gatti or Mary Wicklander.
Upon motion by Scalze, seconded by Blesener, the public
hearing was closed.
Mrs. Scalze introduced the following resolution and
moved its adoption:
RESOLUTION NO. 91-7-224 - DENYING THE REQUEST OF
MICHAEL GATTI AND MARY WICKLANDER FOR RELOCATION
BENEFITS BASED ON NO FURTHER INFORMATION BEING
PRESENTED AT THE PUBLIC HEARING OTHER THAN THE
RECOMMENDATION OF THE CITY ATTORNEY, AND BASED ON THE
FACT THAT THE OCCUPANTS DID NOT OCCUPY THE PREMISES IN
QUESTION FOR 90 DAYS PRIOR TO COMMENCEMENT OF
CONDEMNATION PROCEEDINGS AS REPRESENTED IN A LETTER
FROM THE PROPERTY OWNER AND UPON INSPECTION OF THE
PROPERTY BY CITY STAFF
The foregoing resolution was duly seconded by Blesener.
Ayes (4) Scalze, Blesener, Collova, Hanson.
Nays (0).
Resolution declared adopted.
EXEMPTION St. John's Church has submitted Applications for
FROM LAWFUL Exemption from Lawful Gambling license for their Fall
GAMBLING Festival to be held on September 29, 1991, and two
LICENSE bingo events to be held October 27th and November 24th.
ST.
