MINUTES <br />CITY COUNCIL <br />JULY 10, 1991 <br />second is to take action to correct the problem. <br />Hanson pointed out that as early as 1982 the City <br />contacted a resident on Payne Avenue about using the <br />drainage swale area as a garden. Hanson pointed out <br />that some residents have filled in these swale areas. <br />George pointed out that the City had control when the <br />area was being developed, and felt that the Building <br />Inspector should have done his job and protected the <br />swale area when the homes were beinq constructed. <br />Hanson suggested that the problem now be corrected, and <br />pointed out the solutions beinq offered by the City <br />Engineer. <br />The City Administrator pointed out that the City has <br />not taken the position of having no responsibility in <br />the matter. There have been a lot of contributing <br />factors in this situation, those being the homeowners <br />and developers as well as the City, The Administrator <br />pointed out that the City Council has said that the <br />City will pick up 50% of the cost of the improvement <br />through the use of excess Tax Increment Financing <br />funds, and will not assess the property owners for the <br />full cost of the improvement. <br />Stephanie Jansen, 3012 Valento Lane, asked the size of <br />the ditch with the drain tile installed. <br />The City Engineer reported that the drain tile would be <br />installed about one foot beneath the bottom of the <br />ditch. The ditch will be surfaced with sod and about 2 <br />feet wide at the bottom. Sides on the ditch will be at <br />a 4-to-1 slope, except in those areas where backyards <br />have been built up. The slope will be slightly greater <br />in those cases, but will still be maintainable. <br />The City Administrator reported that if the project is <br />approved and when design is completed, there will be <br />profiles of the ditch drawn that property owners can <br />review. <br />Jack Borgestad, 29g5 Thunder Bay Road, asked why drain <br />tile was being recommended and what guarantees there <br />were that it would work. <br />The City Engineer explained the two alternatives for <br />ditch improvement, one involving only regrading and <br />resodding, and the other including drain tile as well. <br />The Engineer reported that it was the impression of <br />staff from the last meeting that most of the property <br />owners wanted to be able to maintain the ditch area. <br />Page 4 <br />
