MINUTES <br />CITY COUNCIL <br />JULY 24, 1991 <br />CONDITIONAL Scalze opened the public hearing to consider the <br />USE PERMIT application for Conditional Use Permit to allow a <br />FOR FENCE special use fence at 43 East County Road B as <br />RALPH MARCHE requested by Ralph Marche. Scalze pointed out that the <br />Planning Commission recommended approval of the CUP by <br />a 5 to 1 vote subject to the recommendations of the <br />City Planner and subject to reversing boards or <br />indenting fence panels to break up the straight <br />appearance of the fence. <br />The City Planner reported that he met with Mr. Marche <br />last week, and he has agreed to indent sections of the <br />fence so that it does not have the appearance of a long <br />solid wall. Mr. Marche has also agreed to landscape <br />along the fence. <br />The City Planner explained that the Code provides for <br />different fence design requirements for each zoning <br />district. The Code also provides for a Conditional Use <br />Permit process for special use fences like this one. <br />Due to the location of the property along County Road B <br />and the non-conforming residential use in a business <br />and industrial district, as well as the significant <br />traffic and noise, the Planner felt this application <br />fell under the Conditional Use Permit for special use <br />fences. <br />Scalze asked why a 6-foot fence height was necessary. <br />Mr. Marche replied that due to the amount of traffic on <br />County Road B and traffic noise, as well as traffic in <br />and out of the mini-storage, Hide-A-Way and Cub Foods <br />across the street, he is requesting a 6-foot high fence <br />to help reduce noise. <br />Blesener pointed out that Mr. Marche is proposing a 1~ <br />foot setback for the fence. Blesener asked if the <br />setback was from the property line or the road itself. <br />Marche reported that he is requesting a 14 foot setback <br />from the curb of County Road B. That would be one foot <br />within the property line. <br />Blesener stated that his concern was from a safety <br />standpoint, and felt the fence may block visibility for <br />drivers backing out of the Marche driveway or coming <br />out of the mini-storage property. <br />The City Planner pointed out that the average length of <br />a car is 17 feet. <br />Marche stated that he has a turn-around in his driveway <br />Page 17 <br />
