MINUTES <br />CITY COUNCIL <br />OCTOBER 9, 1991 <br />Council discussed whether or not a public hearing was <br />necessary before a charitable qambling ordinance is <br />adopted. <br />The City Attorney replied that State Law requires a <br />public hearing before amending the Zoninq Ordinance, <br />however, the Code can be amended without the need for a <br />public hearing. <br />LaValle pointed out that the intent is to establish an <br />ordinance regulating charitable gambling in the City. <br />The State would like all cities to adopt such an <br />ordinance so that cities can have some hands-on <br />control. <br />Scalze aqreed that this is not out-of-line with what <br />other cities have done, and noted that in the past the <br />City has only had a very informal policy regarding <br />charitable gambling. <br />Blesener began review of the October 2nd workshop <br />meeting minutes suggesting that the provision for a <br />City one-year premise permit should be moved up in the <br />sequence of provisions. Blesener also suggested a <br />change in wording of one provision, indicating that it <br />should state "No employee, member, principle officer or <br />consultant shall have been convicted of a felony...". <br />Blesener indicated that the City would then confirm <br />this fact. Blesener further noted that a provision <br />needs to be included about the 10% late fee for funds <br />due the City if not paid within the 30 day time frame <br />allowed. <br />Blesener suggested that with regard to the provision <br />requiring an address in the City for the past three <br />years, any existing organization not conforming to this <br />requirement may be grandfathered in if approved by the <br />City Council at the time of next license renewal. <br />LaValle agreed, pointing out that one organization <br />operating at the bingo hall recently had an address <br />outside the City for a short time, and has now <br />relocated back into the City. <br />Collova asked if the City needs a basis for approval or <br />non-approval of gambling licenses. <br />LaValle replied that according to State Law this is not <br />necessary. <br />Blesener had concern with the wording of the trade area <br />provision, feeling that the City was not large enough <br />to accommodate this provision as worded.
