MINUTES <br />CITY COUNCIL <br />OCTOBER 23, 1991 <br />Scalze stated that she was not in favor of a special <br />use permit because if one auto repair business is <br />allowed to continue in the I-P District even by special <br />use permit, the City will be hard-pressed to deny the <br />next request. Scalze stated that she would like to <br />give Spectrum Auto some time to relocate. <br />Blesener agreed. <br />LaValle suggested that under a special use permit once <br />the ownership of the building changed, then the special <br />use permit would be gone. The use would only be <br />grandfathered as along as the ownership remained the <br />same. <br />The City Planner reported that a special use permit <br />runs with the land and not ownership. Therefore, <br />Spectrum Auto could move out and another auto repair <br />business move in. <br />Collova stated that he would support the recommendation <br />of the Planning Commission, but with a longer time <br />period for relocation. <br />Spectrum Auto reported that it took longer than six <br />months to find their present location. Spectrum <br />reported that they first located at the site on a <br />3-month trial basis. After that they entered into a <br />one-year lease, which expires on August 1, 1992. <br />LaValle stated that he would not oppose allowing <br />Spectrum to remain as long as the ownership of the <br />building does not change. <br />Scalze pointed out that no one wants to say that <br />Spectrum cannot do business, because they are doing a <br />good job and not impacting anyone. However, the <br />Council's job is to be fair to every applicant. <br />LaValle pointed out that Spectrum Auto is an existing <br />business. <br />Scalze pointed out that the City did not approve an <br />auto or truck repair business, but rather the Quality <br />Asphalt business. <br />Hanson asked what would happen to the property <br />currently occupied by the Brings Onion Company if that <br />business ceased to exist. <br />Scalze pointed that the allowable uses for the I-P <br />District are listed in the Zoning Code. <br />Page 4 <br />
