MINUTES <br />CITY COUNCIL <br />OCTOBER 29, 1991 <br />The Engineer replied that there was discussion about <br />disturbing as few trees as possible. <br />George disagreed. <br />Pete DeZurik, 3025 Ontario Road, presented the Council <br />with pictures of the drainage area behind his home <br />after a heavy rainfall. DeZurik reported that his <br />ditch area has always drained, and questioned the need <br />for an improvement. DeZUrik asked if the easement area <br />was owned by the City. <br />Blesener reported that the easement area is owned by <br />the property owner, the City only has an easement over <br />the property for purposes of drainage. <br />DeZurik expressed concern that the contractor doinq the <br />project did not take into consideration any <br />improvements that property owners might have, such as <br />sprinkler systems. DeZurik also questioned why the <br />property owners are being assessed for an improvement <br />that has not been completed. DeZurik was concerned <br />about the job being completed properly if the work is <br />already paid for. <br />The City Administrator reported that drainage <br />improvements are many times assessed before work is <br />started. The Administrator pointed out that in this <br />particular project there were negotiations that <br />effected the start date of the project. The <br />Administrator also pointed out that if the City waited <br />until next year to assess this improvement, interest <br />charges would have to be added to the project costs to <br />cover the City~s costs in carrying the project. <br />The City Administrator reported that the City's <br />contract for the improvement contains performance <br />standards that will ensure that the project is <br />completed as specified. The City also holds a bond <br />that provides for additional security that the job will <br />be done satisfactorily. <br />DeZurik reported that the residents have been told that <br />after the improvement, the ditch will not be wet <br />anymore. DeZUrik asked what will happen if the ditch <br />is still wet. <br />The City Engineer reported that the drainage <br />improvement is the best solution for the drainage <br />problems that the area has experienced. This <br />improvement allows some place for the water to go. The <br />Engineer also reported that the better property owners <br />Page 11 <br />
