MINUTES <br />CITY COUNCIL <br />OCTOBER 29, 1991 <br />the entire ditch system to flow. <br />DeZUrik was concerned that the ditch area is being <br />filled in somewhat by the improvement, and this will <br />cause ponding closer to homes during heavy rains. <br />The City Administrator pointed out that the ditch <br />improvement will cause the ditches to drain faster, <br />therefore, water will not pond as much as it has in the <br />past. <br />Sandy Anich asked if property owners could pay their <br />assessment at any time, and pointed out that the notice <br />indicates that if assessments are paid even two weeks <br />after the initial 30 day period, property owners will <br />have to pay a full year's interest. <br />The City Administrator again pointed out that if <br />assessments are paid within 30 days of adoption, there <br />is no interest due. After that point assessments must <br />be paid to the County with interest. If assessments <br />are paid on November 15th or later, the assessment is <br />due with interest through December 31st of the <br />succeeding year. Therefore, if property owners wish to <br />pay off assessments in the future, they can make the <br />best use of their money by paying assessments shortly <br />before the November 15th date. The Administrator also <br />pointed out that State Law does not allow for partial <br />pre-payment of assessment. <br />Tracey George reported that she cleared her ditch area <br />and removed a tree, although she delayed sodding of the <br />area. George asked if this would cause her final <br />assessment to be reduced. <br />The City Administrator reported that it would not since <br />the City must be consistent in the application of <br />assessments based on benefits received. <br />George pointed out that she is payinq for property <br />owners who did not maintain their ditch areas while she <br />did. <br />The City Administrator pointed out that there are <br />properties that have final finished their ditch areas, <br />who could argue that they are paying for those <br />properties that did not. The Administrator again <br />pointed out that assessments must be based on equal <br />benefits received. <br />One property owner questioned how the Ditch B area will <br />dry out. <br />Page 13 <br />
