MINUTES <br />CITY COUNCIL <br />NOVEMBER 13, 1991 <br />CHARITABLE The City Attorney presented a redraft of the proposed <br />GAMBLING charitable gambling ordinance which incorporates <br />ORDINANCE Council discussion at its last meeting regarding the <br />ordinance. The Attorney noted that since its last <br />meeting, the Council has received a number of letters <br />from various charities commenting on the proposed <br />ordinance. <br />With regard to St. Joseph's Society's comments <br />regarding the ordinance provision dealing with <br />convicted felons, the City Attorney stated that he <br />would research State Law regarding these comments. <br />Hanson noted that the issue was also raised regarding <br />the City's right to revoke or suspend a State-issued <br />license. <br />The City Attorney replied that the ordinance as <br />prepared, anticipates the City's right to revoke its <br />approval of a premises permit for violation of <br />conditions of the permit. That information would then <br />be submitted to the State requesting revocation. The <br />Attorney reported that revocation of the City~s <br />approval of a premises permit is clearly within the <br />Law. <br />Hanson noted the comments regarding the ordinance <br />provision requiring that an organization must have <br />maintained an address in the City for at least three <br />years as well as the provision allowing the Council to <br />waive that requirement for license renewal of an <br />existing organization. <br />Blesener stated that he felt the City's boundaries were <br />too small to apply this type of requirement. Blesener <br />stated that he would be more comfortable with requiring <br />an organization to have existed for at least three <br />years within the City's trade area. <br />Collova agreed. <br />Scalze felt that there were enough local organizations <br />that may be interested in charitable gambling so that <br />this provision is not a problem. LaValle agreed, and <br />pointed out that some existing organizations may be <br />interested in additional sessions. <br />Hanson noted that even without the 3-year provision, <br />the City has the ability to give Little Canada <br />organizations priority. <br />Scalze felt that the provision made the City's intent <br />clear.
