MINUTES <br />CITY COUNCIL <br />NOVEMBER 27, 1991 <br />Mr. Blesener introduced the following resolution and <br />moved its adoption: <br />RESOLUTION N0. 91-11-397 - CALLING A PUBLIC HEARING FOR <br />WEDNESDAY, FEBRUARY 26, 1991, AT 7:30 P.M. TO CONSIDER <br />AMENDING TAE COMPREHENSIVE LAND USE PLAN TO SHOW THE <br />SOUTH SIDE OF LITTLE CANADA ROAD AREA ALONG ROUND LAKE <br />AS OPEN SPACE BASED ON THE RECOMMENDATION OF THE <br />PLANNING COMMISSION <br />The foregoing resolution was duly seconded by Scalze. <br />Ayes (5) Blesener, Scalze, Collova, Hanson, LaValle. <br />Nays (0). <br />Resolution declared adopted. <br />APPEAL OF Hanson opened the public hearinq to consider the appeal <br />DENIAL OF of Conditional Use Permit and Variance to the Code to <br />VARIANCE & allow improvements to a property in excess of 50% of <br />CUP - 34 fair market value of non-conforming structure at 34 <br />LITTLE Little Canada Road submitted by Jim Marshall. <br />CANADA RD. <br /> The City Planner reported that at the Planning <br /> Commission meeting Mr. Jim McBride, representing Jim <br /> Marshall, indicated verbally that they were withdrawinq <br /> the appeal of Council denial. McBride had indicated <br /> that they planned to pursue the matter by repairing the <br /> structure to meet UBC requirements, and would be <br /> applying for a building permit for these repairs. The <br /> Planner reported that at that meeting he requested that <br /> Mr. McBride or Mr. Marshall submit the withdrawal in <br /> writing. xowever, no written withdrawal has been <br /> received, therefore, the application is still active. <br />There was no one from the general public present <br />wishing to comment on this matter. <br />Upon motion by Blesener, seconded by Scalze, the public <br />hearing was closed. <br />Mr. Blesener introduced the following resolution and <br />moved its adoption: <br />RESOLUTION N0. 91-11-398 - DENYING THE APPEAL OF <br />PREVIOUS COUNCIL ACTION DENYING APPLICATION FOR <br />CONDITIONAL USE PERMIT AND VARIANCE IN ORDER TO MAKE <br />IMPROVEMENTS TO THE STRUCTURE AT 34 LITTLE CANADA ROAD <br />IN EXCESS OF 50% OF FAIR MARKET VALUE BASED ON THE <br />RECOMMENDATION OF THE PLANNING COMMISSION AND THE FACT <br />THAT NO NEW INFORMATION AAS BEEN SUBMITTED RELATIVE TO <br />THIS MATTER <br />The foregoing resolution was duly seconded by LaValle. <br />Page 3 <br />
