MINUTES <br />CITY COUNCIL <br />DECEMBER 11, 1991 <br />influenced one way or the other. The Administrator <br />asked for some clarification from the Council. He <br />reported that in his discussions with Mr. Costa, <br />concern has been expressed for a fair and objective <br />appraisal as well as the land usage that will be used <br />in setting a value. The Administrator reported that he <br />has informed Mr. Costa that if the property is valued <br />as Publio property and a zero value set, he doubted <br />whether that would be acceptable to the City. The <br />Administrator suggested that the City would be <br />hard-pressed to push for consideration as Industrial <br />property. It was the Administrator's opinion that R-1 <br />should be the basis as highest and best use, since that <br />is the usage of the property across the street. <br />Mr. Costa indicated that he was comfortable with R-1. <br />Costa reported that his attorney has informed him not <br />to sign any further documents with the City until he <br />determines that the appraisal will be acceptable to the <br />City. <br />The City Administrator reported that the value <br />discussed with Mr. Costa was somewhere between a$0 and <br />$2 range. <br />Blesener suggested that the value may come in at over <br />$2 per square foot. <br />The City Administrator stated that he did not believe <br />the intent was to increase the value of the land over <br />the $2 figure. <br />Collova asked about the use of comparibles. <br />Costa reported that his attorney indicated that the <br />situation should be compared with road condemnation. <br />Costa suggested that since neither he nor the Council <br />were experts in these matters, that it should be left <br />to the appraiser. <br />The City Administrator suggested that the taking has to <br />be based on a value, and reported that the appraiser <br />has been informed that the taking involves a strip of <br />property for a roadway from park land that should <br />probably be valued as R-l. <br />The City Attorney reported that the appraiser will <br />consider what the highest and best use of the property <br />is, considering the entire parcel, and not just the <br />strip in question. The appraiser will, most likely, do <br />a before and after appraisal of the entire piece. <br />Scalze pointed out that the problem is that Mr. Costa <br />Page 11 <br />
