MINUTES <br />CITY COUNCIL <br />JANUARY 8, 19 92 <br />DESOTO STR. The City Administrator reported that as discussed with <br />ASSESSMENTS Mr. Costa, the DeSoto Street easement was appraised. <br /> The appraiser set a value of 40 cents per square foot <br /> on the property, however, the City has set a minimum <br /> value of $1 per square foot. In order to correct the <br /> assessments, the City will have to relevy those <br /> assessments at $1 per square foot. The Administrator <br /> further reported that Mr. Costa went down to the County <br /> to record his plat and was informed that he must pay <br /> current year's taxes, which include the first year's <br /> assessments. Mr. Costa is not pleased with this given <br /> the fact that there is no income coming in from the <br /> property. Mr. Costa also indicated that the City did <br /> not communicate to him that the assessments which were <br /> levied this past fall would begin to be collected in <br /> 1992. The Administrator also pointed out that the plat <br /> has not been handled in a timely manner, and i£ it had <br /> been recorded in 1991, the 1992 taxes would not have <br /> been payable at recording. <br />The Administrator reported that the City may have the <br />option of abating the assessments for the Costa <br />property, and then relevying them at a 9-year term. As <br />a result, the first year's assessment payment would be <br />due in 1993, and the 9-year term would allow the <br />assessments to keep pace with repayment of the City's <br />bond issue. <br />The City Attorney believed it to be within the power of <br />the City to abate the assessments and the reassess. <br />However, he did not know if this would work <br />procedurally for the County as regards the first <br />installment of the assessment. <br />Blesener stated that he had no problem abating and <br />reassessing as long as it did not hurt the City in any <br />way. <br />The Attorney suggested that if the City does this the <br />appropriate waivers will be necessary from the property <br />owner. Council suggested that the property owner also <br />be responsible for whatever costs are involved. <br />Mr. LaValle introduced the following resolution and <br />moved its adoption: <br />RESOLUTION N0. 92-1-23 - INSTRUCTING CITY STAFF TO <br />BEGIN THE PROCEDURE NECESSARY TO ABATE ASSESSMENTS FOR <br />IMPROVEMENT NO. 90-21 FOR THE PETER AND ROSE COSTA <br />PROPERTIES, AND, IF ABATED, STAFF TO TAKE THE STEPS <br />NECESSARY TO REASSESS THE PROPERTY BASED ON A 9-YEAR <br />ASSESSMENT PERIOD AND CALLING A PUBLIC HEARING ON THE <br />PROPOSED RE-ASSESSMENT OF IMPROVEMENT NO. 90-21, DESOTO <br />STREET, FOR WEDNESDAY, FEBRUARY 12, 1992, AT 7:30 P.M. <br />Page 28 <br />
