Stellick <br />reported that he realizes that there is not a bingo <br />hall license available in the City at this time, but if <br />one becomes available, having the CUP would make them <br />more prepared. <br />Blesener asked if approval of the CUP would put the <br />City in a difficult legal position since there is no <br />bingo hall license available. Blesener asked if the <br />Market Place could approach the State and inform them <br />that the City has approved them as a bingo hall site. <br />The City Attorney did not believe action on the CUP <br />would put the City in a difficult legal situation. The <br />Attorney pointed out that Mr. Stellick's letter states <br />his reasoning for requesting the CUP and the fact that <br />he is aware that there is no bingo hall license <br />available. The only one allowed by the City is <br />currently being used by someone else. The Attorney <br />reported that Mr. Stellick is aware that approval of <br />the CUP would qive him no vested rights for subsequent <br />issuance of a bingo hall license. <br />Blesener asked about a situation where some of the <br />charities at the bingo hall decide to relocate. <br />Blesener asked if the present bingo hall site had no <br />charities, would the hall owner retain the bingo hall <br />license. <br />The City Attorney stated that he believed the owner had <br />the riqht to the bingo hall license until its <br />expiration. <br />Scalze was concerned that the City gets put in the <br />middle should the charities decide to relocate to <br />another hall. <br />The City Attorney pointed out that this situation might <br />exist without the issuance of this conditional use <br />permit. The City Attorney felt that the only issue of <br />any concern was that Mr. Stellick should be on record <br />as acknowledging that the issuance of a conditional use <br />permit would not give him any vested right in the <br />subsequent issuance of a bingo hall license. <br />Mr. Stellick stated that he acknowledged this as <br />outlined by the City Attorney. <br />There was no one from the general public present <br />wishing to comment on this matter. <br />Page 7 <br />
