MINUTES <br />CITY COUNCIL <br />APRIL 22, 1992 <br />planning to construct be 1 to 2 feet above the ground <br />water levels. Low reported that he would comply with <br />this requirement. <br />Mr. LaValle introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 92-4-140 - APPROVING THE FILL PERMIT FOR <br />730 CARLA LANE AS REQUESTED BY MR. JOE FRANCIS AND MR. <br />JOHN LOW SUBJECT TO THE RECOMMENDATIONS OF THE CITY <br />ENGINEER, WATERSHED AND CITY STAFF <br />The foregoing resolution was duly seconded by Blesener. <br />Ayes (5) LaValle, Blesener, Collova, Scalze, Hanson. <br />Nays (0). Resolution declared adopted. <br />TRAIL/ Scalze reported that the Park Commission has <br />UTILITY recommended retention of a 10 foot trail easement down <br />EASEMENT the middle of the existing 20 foot utility/trail <br />105 EAST easement adjacent to 105 East Old County Road C. <br />OLD COUNTY Scalze reported that if this recommendation is adopted <br />ROAD C by the City Council, then the property owner, Jim <br /> Zietlow, would have to make application for vacation of <br /> the portion of the easement that would not be necessary <br /> for trail. Scalze also reported that Mr. Zietlow has <br /> planted three pine trees down the middle of the <br /> easement area, and the neighbors would like these trees <br /> removed since the trail easement is currently being <br /> used. Scalze reported that it is thought that the <br /> trees are small enough that they could be moved. <br /> Scalze noted that the Park Commission has indicated <br /> that improvement of a blacktop path on the trail <br /> easement will not happen in the near future. <br />Hanson thought from discussion at the Park Commission <br />meeting that Mr. Zietlow has agreed to move the trees. <br />Jim Coopet, 141 Bluwood, reported that he and his <br />children use the trail easement. Coopet indicated that <br />the trees need to be moved because as they grow they <br />will block the walkway area. <br />Scalze noted the petition signed by 22 residents of the <br />area indicating their support for retention of the <br />trail easement. <br />Blesener agreed that according to the Park Commission <br />minutes, Zietlow has stated he would move the trees. <br />Blesener pointed out from the Park Commission minutes <br />the recommendation that a 10 foot trail easement be <br />retained down the middle of the existing 20 foot <br />easement from Bluwood Avenue to County Road C. <br />Page 15 <br />
