MINUTES <br />CITY COUNCIL <br />APRIL 22, 1992 <br />Scalze again stated that if Zietlow would like to make <br />application for vacation of a portion of the easement, <br />he has that right. Scalze suggested that in fairness <br />to Zietlow, however, the Council should let him know <br />their position on the matter before he incurs any <br />costs. <br />Blesener indicated that after input and discussion that <br />has been held at the Park Commission level, he would <br />endorse the Park Commission's recommendation. Blesener <br />felt it necessary to retain the entire 20 foot easement <br />for utility and drainage purposes. <br />Hanson stated that he would not encourage Zietlow to <br />apply for a vacation since the trail easement is <br />included in the proposed Park Master Plan and retention <br />of the utility easement has been recommended by the <br />City Engineer and Public Works. <br />Blesener pointed out that the City went through the <br />process in considering vacation of the road <br />right-of-way, and it was the recommendation of the City <br />Enqineer that the 20 foot drainage/utility easement be <br />retained. <br />Scalze again pointed out that the trees should be <br />removed since people are using the trail easement. <br />Council discussed this and felt that the trees could be <br />safely relocated if done so by June 1st. <br />Mr. Blesener introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 92-4-141 - ACCEPTING THE RECOMMENDATION <br />OF THE PARK COMMISSION REGARDING RETENTION OF A 10 FOOT <br />TRAIL EASEMENT DOWN THE CENTER OF THE EXISTING 20 FOOT <br />DRAINAGE/UTILITY EASEMENT, AND INSTRUCTING THE CITY <br />ADMINISTRATOR TO NOTIFY MR. JIM ZIETLOW TO REMOVE THE <br />THREE EXISTING EVERGREEN TREES THAT ARE LOCATED ON THE <br />TRAIL EASEMENT WITHIN THE NEXT 45 DAYS <br />The foregoing resolution was duly seconded by Scalze. <br />Ayes (5) Blesener, Scalze, Collova, Hanson, LaValle. <br />Nays (0).
