MINUTES <br />CITY COUNCIL <br />APRIL 22~ 1992 <br />CUP FOR Mayor Aanson opened the public hearing to consider the <br />AUTO application for Conditional Use Permit submitted by <br />DEALER'S Dennis 0'COnnell of Suburban Auto in order to purchase <br />LICENSE and trade-in vehicles in conjunction with courtesy and <br />SUBURBAN loaner vehicle program. <br />AUTO <br />Scalze pointed out the letter submitted by the Public <br />Works Superintendent about the parking of Suburban Auto <br />employee cars on the street right-of-way. Scalze <br />reported that she has observed this herself, and <br />informed Mr. O'COnnell that cars should be parked no <br />closer than five feet from the street right-of-way. <br />O'Connell reported that he has never been informed that <br />this is a problem. 0'Connell reported that if the <br />parking is a problem, he will make sure that it doesn't <br />happen any longer. <br />Blesener suggested that if it is necessary to park on <br />the road right-of-way, there is inadequate parking on <br />the property, and the City shouldn't allow any <br />additional vehicles on the property. Blesener pointed <br />out that no parking on the road right-of-way can be <br />made a condition of the approval. Blesener reported <br />that he has several other conditions he would like to <br />suggest, and felt none of his conditions would effect <br />Mr. O'Connell's loaner vehicle program. Blesener <br />stated that he did not want to see vehicles parked out <br />in front of the property with for-sale signs on them. <br />Scalze reported that she has a problem with the entire <br />concept. Scalze noted that the City is being asked to <br />authorize an auto dealer's license for a person who is <br />not a dealer, so that person can avoid paying sales tax <br />on vehicles used for loaner and courtesy cars. Scalze <br />felt that the City could be faced with the same request <br />from other auto repair businesses. <br />Scalze pointed out that Mr. 0'Connell has stated that <br />he is not in the car sales business, but has indicated <br />at the Planning Commission meeting that he would like <br />to sell the loaner cars to customers when he no longer <br />needs them. Scalze did not believe the City could <br />police the business, and pointed out that approval of <br />the CUP would give Mr. 0'Connell an auto dealer's <br />license. <br />Blesener suggested that the City could notify the State <br />that the desired use of the MN Dealer's License is not <br />as a dealer, but rather for trade-in advantages for <br />courtesy cars. <br />Page 6 <br />
