MINUTES <br />CITY COUNCIL <br />MAY 13, 1992 <br />RESOLUTION NO. 92-5-155 - CONTINUING THE PUBLIC HEARING <br />ON THE RYAN INDUSTRIAL PARK STREET IMPROVEMENT UNTIL <br />JUNE 10, 1992 AS REQUESTED BY THE BUSINESS OWNERS <br />WITHIN THE PARK <br />The foregoing resolution was duly seconded by Collova. <br />Ayes (5) Blesener, Collova, Hanson, LaValle, Scalze. <br />Nays (0). Resolution declared adopted. <br />FUTURE The City Administrator reported that St. Jude is <br />ST. JUDE concerned about future storm sewer assessments in the <br />MEDICAL event they spend significant dollars for an emergency <br />STORM overflow drainage system to serve their property. <br />SEWER The City Administrator reviewed the letter he has <br />ASSESSMENT drafted committing to no future storm sewer assessments <br />should St. Jude install the overflow system. However, <br />the Administrator reported that the City Engineer is <br />concerned about making such a commitment due to the <br />possibility of the overflow system necessitating the <br />need for a lift station or pumping station similar to <br />Sleep Hollow's. The Engineer feels that should such a <br />lift station be required, the contributing properties <br />would be assessed its cost. <br />The City Administrator reported that he discussed with <br />the City of Maplewood and Ramsey County the likelihood <br />that a storm sewer improvement would take place along <br />County Road B. Neither thought such an improvement was <br />likely. <br />The Administrator reported that he has informed St. <br />Jude that they would not be assessed for any <br />improvement that did not benefit their property, and <br />suggested that he redraft his letter to include some <br />additional specifics. The Administrator recommended <br />approval of such a letter subject to review and <br />approval by the City Attorney and City Engineer. <br />Mr. LaValle introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 92-5-156 - AUTHORIZING THE CITY <br />ADMINISTRATOR TO SEND A LETTER TO ST. JUDE MEDICAL <br />INFORMING THEM THAT THEY WOULD NOT BE RESPONSIBLE FOR <br />ANY FUTURE STORM SEWER IMPROVEMENTS WxICH DID NOT <br />BENEFIT THEIR PROPERTY, THAT LETTER TO BE REVIEWED AND <br />APPROVED BY THE CITY ATTORNEY AND CITY ENGINEER <br />The foregoing resolution was duly seconded by Collova. <br />Ayes (5) LaValle, Collova, Hanson, Blesener, Scalze. <br />Nays (0).
