MINUTES <br />CITY COUNCIL <br />MAY 27, 1992 <br />Malsam reported that he has tried to contact the <br />developer, Mr. Brueggemann, and his phone calls are not <br />returned. Malsam asked if it were possible to get <br />another developer in to finish the final phases. <br />Malsam pointed out that he cannot sell his property. <br />Hanson reported that the City is putting pressure on <br />Mr. Brueggemann. Hanson reported that he recently <br />spoke with Brueggemann, who indicated that some changes <br />will be made. Hanson reported that Mr. Brueggemann and <br />his partner are splitting, and each will get one of the <br />buildings. Hanson reported that he informed <br />Brueggemann that the City will not back off until the <br />situation is corrected. <br />The City Administrator reported that he has had <br />conversations with and sent letters to Mr. Brueggemann, <br />who has promised action. However, enough time has <br />lapsed and no action has taken place. The <br />Administrator recommended that the Council grant the <br />authority to proceed against the landscape bond as well <br />as to cite Mr. Brueggemann for any ordinance violations <br />at Kandice Heights. <br />Blesener also suggested that the City go against M& T <br />Welding for their outside storage. <br />Mr. Blesener introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 92-5-179 - AUTHORIZING THE CITY <br />ADMINISTRATOR, CITY ATTORNEY AND BUILDING OFFICIAL TO <br />PROCEED AGAINST THE LANDSCAPE BOND FOR TAE KANDICE <br />HEIGATS DEVELOPMENTS AND TO ISSUE CITATIONS FOR ANY <br />ORDINANCE VIOLATIONS IN CONNECTION WITH THOSE <br />DEVELOPMENTS <br />The foregoing resolution was duly seconded by Scalze. <br />Ayes (5) Blesener, Scalze, Hanson, LaValle, Collova. <br />Nays (0). Resolution declared adopted. <br />Blesener stated that he agreed with Malsam, and <br />indicated that if another developer approached the City <br />on the third phase, the City would be interested in <br />pursuing the matter. <br />The City Administrator pointed out that it was always <br />the City's position that it gave no allegiance to any <br />one developer. The problem is the economy, and Mr. <br />Brueggemann has been the only developer that was able <br />to obtain financing for the project. The Administrator <br />reported that Mr. Brueggemann has informed him that he <br />has both temporary and permanent financing approval for <br />Page 13 <br />
