MINUTES <br />CITY COUNCIL <br />MAY 27, 1992 <br />Kandice Heights Phase III. The Administrator reported <br />that he has informed Brueggemann that at this point <br />actions speak louder than words. The Administrator <br />reported that if the City wants to take a more active <br />approach in locating another developer, it could go to <br />an RFP, however, the Administrator questioned the <br />success of this approach given the economy, especially <br />considering this is the process used and he was only <br />one of two interested parties. The other party is no <br />longer in business. <br />Malsam asked why the City could not put the project out <br />to another developer. Malsam pointed out that <br />Brueggemann had stated that he had Phase III 90% <br />ocaupied, however, suggested that these commitments are <br />not going to stick by him if nothing is happening. <br />Malsam pointed out that existing tenants of Phases I <br />and II are not happy. <br />The Administrator pointed out that the problem is that <br />the City is not a developer, and has not been <br />approached by another developer for this project. <br />Short of putting together an RFP, the Administrator was <br />not sure what the City could do. <br />Malsam asked if his property could be rezoned, pointinq <br />out that he could have sold it at one time except for <br />the PUD zoning. That potential buyer purchased a <br />parcel on Viking Drive and is now running the same <br />business that he proposed on the Malsam property. <br />Scalze asked about that business. <br />The City Administrator reported that the owner was <br />red-tagged last fall since he started building without <br />a permit. The Administrator reported that he would <br />check on the status of that property. <br />Malsam asked if Council approval was necessary on any <br />property transaction on Country Drive. Malsam reported <br />that there is a vacant piece of property that he is <br />considering purchasing. <br />It was indicated that Council approval is not necessary <br />in a real estate transaction. <br />George Zender, property owner in the area, pointed out <br />that the situation along Country Drive has been going <br />on for several years. Zender reported that he wants to <br />sell his property and cannot. Zender further reported <br />that assessments and property taxes are costing him <br />about $200 per month. Zender stated that traffic <br />speeds on the road are dangerous, his house has been <br />broken into, people are roaming the neighborhood, and <br />the quality of life is declining. Zender felt that the <br />City has bent over backwards to accommodate Gagne and <br />Brueggemann, but the residents in the area have been treated unfairly. <br />Page 14 <br />
