MINUTES <br />CITY COUNCIL <br />MAY 27, 1992 <br />for auto sales, however, this particular application <br />was submitted prior to the adoption of that moratorium. <br />The City Attorney agreed that since the application was <br />submitted prior to adoption of the moratorium, it <br />should be processed as if the moratorium did not exist. <br />Scalze pointed out that in this instance the applicant <br />has indicated that he will not conduct retail sales <br />on-site, and there will be no advertisement of vehicles <br />for sale at the site. Scalze felt that if the CUP is <br />approved, it should be subject to those conditions for <br />both the current and any future property owners. <br />Blesener expressed concern with approval of the CUP if <br />it will result in a problem in the applicant's <br />residential neighborhood. Blesener noted that the <br />applicant has indicated that he sells vehicles from his <br />home, and asked about the effect on neighbors from a <br />number of vehicles for sale displayed in his driveway. <br />Mr. Luciano reported that the majority of his business <br />is auto repair and he only sells about 2 or 3 cars per <br />month, either to customers or through newspaper <br />advertisements. Luciano reported that the car he <br />drives home on the weekend would be the one that is <br />advertised for sale. <br />There was no one from the general public present <br />wishing to comment on this matter. <br />Upon motion by Collova, seconded by Blesener, the <br />public hearing was closed. <br />Mrs. Scalze introduced the following resolution and <br />moved its adoption: <br />RESOLUTION N0. 92-5-173 - APPROVING THE CONDITIONAL USE <br />PERMIT FOR RETAIL AUTO SALES IN RYAN INDUSTRIAL PARK <br />FOR LENARDO BODY SHOP, 3168 RYAN LANE, SUBJECT TO THERE <br />BEING NO RETAIL SALES AT THE SITE AS STATED BY THE <br />APPLICANT, NO EXTERIOR SALES SIGNS, BANNERS, OR <br />BALLOONS, ETC., AND CONDITIONED THAT SINCE THE PERMIT <br />RUNS WITH THE PROPERTY, ANY FUTURE OWNER WOULD BE <br />SUBJECT TO THESE SAME CONDITIONS <br />The foregoing resolution was duly seconded by Collova. <br />Ayes (5) Scalze, Collova, Blesener, Hanson, LaValle. <br />Nays (O). Resolution declared adopted. <br />3120 Mr. Tim Wright, Edina Realty, appeared before the <br />LABORE Council requesting approval of the division of <br />ROAD property at 3120 LaBore Road into two lots.
