MINUTES <br />CITY COUNCIL <br />JUNE 16, 1992 <br />Blesener suggested that if the property owners had any <br />concerns about the project, they discuss them with the <br />City Engineer and City Administrator. <br />RECESS At this point in the meeting, 9:20 P.M., Council took a <br />short recess. The meeting was reconvened at 9:25 P.M. <br />KLEIN Mr. David Klein reported that he did not want the <br />PROPERTY Council to misunderstand, his mother wanted the house <br />at 2620 Rice Street taken down as soon as possible, but <br />she also wanted to keep the cost down. Klein also <br />reported that while the Order to Raze was signed on <br />April 10th, it was not served until April 22th. <br />David Klein also pointed out that the letter sent by <br />the City Attorney's office, Mr. Doug Meslow in <br />particular, indicated that the City would not proceed <br />until bids could be reviewed by Mrs. Klein's attorney. <br />Klein also indicated that the City Administrator's <br />letter indicated that at least two complete quotations <br />would be obtained for the work, and Klein questioned <br />that the City had two complete quotations since some <br />did not include well abandonment. Klein stated that <br />they felt a cost in the $5,000 range was fair, but that <br />a$7,000 cost would be too high. Klein also reported <br />that a couple of paragraphs in the Authorization to <br />Raze Agreement, the Klein attorney does not agree with. <br />The City Attorney pointed out that the Agreement <br />referred to is the voluntary agreement, which was not <br />signed by Mrs. Klein, therefore, the City proceeded <br />with authorization to raze under the hazardous building <br />statutes. <br />Blesener pointed out that Mrs. Klein had almost one <br />year to sign the voluntary agreement. Blesener <br />indicated that the City has tried to work with Mrs. <br />Klein for almost a year. <br />Mrs. Klein indicated that it took almost six months to <br />get the report on the fire. <br />David Klein questioned the need for removal of the <br />basement. Klein indicated that the basement would not <br />hold water since it is a walk-out. Klein also reported <br />that the foundation next door has been allowed to <br />remain, and one of the walls of that foundation is <br />leaning towards the Klein property. <br />The City Administrator reported that he has no problem <br />working with the Klein attorney to ensure that the <br />lowest bid possible is awarded and that the bid is a <br />complete bid. <br />Page 16 <br />
