MINUTES CITY COUNCIL JUNE 16, 1992 The City Administrator replied that some of the quotations do include well capping, and that he would verify whether or not the apparent low quotation includes well capping. The Administrator also stated that he has no problem working with Mrs. Klein's attorney to ensure that the quotation which is awarded is low and in compliance with specifications. The City Attorney informed Mrs. Klein that if it is her attorney's intention to do something in this matter within a legal framework, he had better hurry. Once the City communicates the quotation information to her attorney, the contractor submitting the low quote will be given notice to proceed. David Klein, Mrs. Klein's son, asked if they should contact the contractor about the well capping. The City Attorney replied that the City will do this, and the matter is in the City's hands because the property owner did not take care of it. Mrs. Klein stated that she had a problem with the procedure being followed and questioned some of the terms of the agreement. It was noted that the agreement being referred to was the voluntary agreement submitted to Mrs. Klein by the City for removal of the structure, and that Mrs. Klein did not enter into the voluntary agreement. The City Attorney noted that the City has agreed to submit quotation information to Mrs. Klein's attorney. That information will be submitted tomorrow morning. The City Attorney also stated that the City will ensure that the quotation awarded is in compliance with specifications, and if the apparent low quote is not, then the City will move onto the next low quote, and so on until it has a quotation that does meet specs. Mr. Blesener introduced the following resolution and moved its adoption: RESOLUTION NO. 92-6-201 - AWARDING THE LOW QUOTATION SUBMITTED BY ANDERSON, RAY & SONS COMPANIES, INC. IN THE AMOUNT OF $5,100.00 FOR REMOVAL OF THE HOUSE LOCATED AT 2620 RICE STREET, AND $1,200.00 FOR REMOVAL OF WARMING HOUSE AT 60 EAST DEMONT AVENUE, AND AWARDING THE LOW QUOTATION SUBMITTED BY BAUER BROS. SALVAGE IN THE AMOUNT OF $5,000.00 FOR REMOVAL OF THE HOUSE AND $600.00 FOR REMOVAL OF THE GARAGE LOCATED AT 2558 RICE STREET, SUBJECT TO COMPLIANCE WITH THE SPECIFICATIONS FOR THIS WORK, AND AUTHORIZING THE CITY ADMINISTRATOR AND CITY ATTORNEY TO MOVE TO TAE NEXT LOW BID, IF NECESSARY, TO ENSURE COMPLIANCE WITH SPECIFICATIONS OR TO MODIFY THE WORK SCOPE ACCORDINGLY TO OBTAIN THE MOST FAVORABLE PRICE Page 3
