MINUTES <br />CITY COUNCIL <br />JUNE 16, 1992 <br />The City Administrator replied that some of the <br />quotations do include well capping, and that he would <br />verify whether or not the apparent low quotation <br />includes well capping. The Administrator also stated <br />that he has no problem working with Mrs. Klein's <br />attorney to ensure that the quotation which is awarded <br />is low and in compliance with specifications. <br />The City Attorney informed Mrs. Klein that if it is her <br />attorney's intention to do something in this matter <br />within a legal framework, he had better hurry. Once <br />the City communicates the quotation information to her <br />attorney, the contractor submitting the low quote will <br />be given notice to proceed. <br />David Klein, Mrs. Klein's son, asked if they should <br />contact the contractor about the well capping. <br />The City Attorney replied that the City will do this, <br />and the matter is in the City's hands because the <br />property owner did not take care of it. <br />Mrs. Klein stated that she had a problem with the <br />procedure being followed and questioned some of the <br />terms of the agreement. <br />It was noted that the agreement being referred to was <br />the voluntary agreement submitted to Mrs. Klein by the <br />City for removal of the structure, and that Mrs. Klein <br />did not enter into the voluntary agreement. The City <br />Attorney noted that the City has agreed to submit <br />quotation information to Mrs. Klein's attorney. That <br />information will be submitted tomorrow morning. The <br />City Attorney also stated that the City will ensure <br />that the quotation awarded is in compliance with <br />specifications, and if the apparent low quote is not, <br />then the City will move onto the next low quote, and so <br />on until it has a quotation that does meet specs. <br />Mr. Blesener introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 92-6-201 - AWARDING THE LOW QUOTATION <br />SUBMITTED BY ANDERSON, RAY & SONS COMPANIES, INC. IN <br />THE AMOUNT OF $5,100.00 FOR REMOVAL OF THE HOUSE <br />LOCATED AT 2620 RICE STREET, AND $1,200.00 FOR REMOVAL <br />OF WARMING HOUSE AT 60 EAST DEMONT AVENUE, AND AWARDING <br />THE LOW QUOTATION SUBMITTED BY BAUER BROS. SALVAGE IN <br />THE AMOUNT OF $5,000.00 FOR REMOVAL OF THE HOUSE AND <br />$600.00 FOR REMOVAL OF THE GARAGE LOCATED AT 2558 RICE <br />STREET, SUBJECT TO COMPLIANCE WITH THE SPECIFICATIONS <br />FOR THIS WORK, AND AUTHORIZING THE CITY ADMINISTRATOR <br />AND CITY ATTORNEY TO MOVE TO TAE NEXT LOW BID, IF <br />NECESSARY, TO ENSURE COMPLIANCE WITH SPECIFICATIONS OR <br />TO MODIFY THE WORK SCOPE ACCORDINGLY TO OBTAIN THE MOST <br />FAVORABLE PRICE <br />Page 3 <br />
