MINUTES <br />CITY COUNCIL <br />JUNE 24, 1992 <br />background check would have to be terminated. The <br />Chief reported that he would be reluctant to get rid of <br />a fire fighter who was not involved in the gambling <br />operation, but who had a conviction for a crime such as <br />tax evasion. <br />Fahey pointed out that the City's ordinance goes beyond <br />what the State requires in this area. Fahey indicated <br />that there are some fire fighters, not involved in the <br />gambling operation, who he believes will refuse to <br />authorize a criminal background check believing it to <br />be an invasion of privacy. <br />LaValle pointed out a meeting he had with Dick Boss <br />regarding concerns the Fire Department had when a <br />disident organization was trying to take over the St. <br />Joseph's Society for Charity gambling operation. <br />LaValle reported that at that time Boss felt the City <br />was lacking in enforcement and urged the City to do a <br />more proactive job of enforcement. <br />Scalze agreed that the reason that the City adopted its <br />gambling ordinance was at the request of the charities <br />to address the problem that was occuring at the binqo <br />hall with the disident group. It was the charities <br />that urged the City to take more control. <br />Fahey felt that the ordinance has created a problem. <br />Fahey felt the requirement of background checks for <br />fire fighters who are not involved in gambling was a <br />harassment of the Fire Department. <br />LaValle pointed out that the City's interests in doing <br />these background checks is to confirm that no officer <br />or member of the governing body of the organization has <br />been convicted of a felony or gross misdemeanor within <br />the past five years, or has ever been convicted of a <br />crime involving gambling. The ordinance also requires <br />confirmation that no director, member, employee or <br />consultant of the organization has been convicted of a <br />felony or gross misdemeanor involving theft, dishonesty <br />or false statement, or involving the sale or possession <br />of a controlled substance within the past five years, <br />or has ever been convicted of a crime involving <br />gambling. <br />Fahey felt that these provisions of the ordinance may <br />have seemed a good at the time the ordinance was <br />adopted, but Fahey questioned that the City needs to <br />have criminal background checks for those individuals <br />not directly involved in the gambling operation. <br />Page 6 <br />
