MINUTES <br />CITY COUNCIL <br />JULY 22, 1992 <br />Joe Fasciana, property owner in the area, reported that <br />the proposal before the Council is a compromise between <br />the neighbors and the developer, and a proposal that <br />has the support of the neighborhood. <br />Earl Silbaugh, property owner in the area, stated that <br />it appears that the new berm will be lower than the <br />existing berm, which will cut down on its shielding <br />capabilities. Silbaugh reported that the Planning <br />Commission discussed noise and lighting concerns raised <br />by the neighbors, and asked if these concerns had been <br />addressed. <br />Hanson reported that after the discussion that took <br />place at the Planning Commission, the Code Enforcement <br />Officer met with St. Jude Medical to discuss the noise <br />and lighting concerns. Hanson reported that the <br />Council has a copy of a letter from the Code <br />Enforcement Officer which indicates that St. Jude has <br />agreed to rel-evaluate these concerns. These concerns <br />have been raised previously, and St. Jude did look at <br />the issue in both 1990 and 1991. <br />Hanson reported that he visited the site one evening, <br />and did not find a noise problem at the time he was <br />there. Hanson indicated that he also looked at <br />lighting and agreed that there are lights coming not <br />only from the industrial park, but also from Garden <br />Terrace apartments and adjacent strip shopping <br />centers. Hanson questioned what kinds of problems <br />might exist in the absence of this lighting, and felt <br />that some lighting was necessary in the interests of <br />public safety. However, Hanson felt the addition of <br />the proposed neighborhood will provide more security <br />for the industrial park, and suggested that lighting <br />could be shielded better. <br />Dan Roberts, Jackson Street resident, raised the issue <br />of noise and asked if businesses are restricted from <br />operating during the night hours. <br />Hanson noted that the ordinance does not prohibit night <br />time work. Hanson again indicated that the City is <br />trying to work with St. Jude to address the noise and <br />lighting issues. <br />Roberts pointed out that the three <br />Street are without sanitary sewer, <br />City will require the developer to <br />sewer for these homes.
