MINUTES <br />CITY COUNCIL <br />SEPTEMBER 9, 1992 <br />was to be fairly substantial to provide screening, <br />however, grading plans show a berm ranging from one to <br />five feet in height. <br />Hanson pointed out that topography descends to the west <br />and he would assume that the 1 to 5 foot difference in <br />elevation occurs with the higher elevation to the west. <br />Kevin Von Reidel, Heritage Development, replied that <br />this was correct. Von Reidel reported that the intent <br />in designing the berm was to provide as much screening <br />as possible, however, given street grades and existing <br />elevations, there was only so much that could be done. <br />Von Reidel reported that Heritage Development plans to <br />plant two to three 12 to 15 foot pine trees on the back <br />of each lot. <br />Blesener stated that he did not think a berm could be <br />built that would accomplish everything that everyone <br />wanted. Blesener pointed out that the higher the berm, <br />the more backyard area would be taken up. <br />Von Reidel reported that Heritage Development would <br />like a building permit for at least one model home this <br />fall. Von Reidel also requested that the development <br />agreement provide that the letter of credit could be <br />reduced as improvements occur and as pay requests are <br />made. Von Reidel pointed out that the project will be <br />constructed on a fast-track, therefore, this may not be <br />an issue. However, Von Reidel requested that the <br />provision be included in the development agreement. <br />Von Reidel was concerned that a weather event such as a <br />large snow storm could delay the project, and Heritage <br />Development would like to be sure that the letter of <br />credit could be reduced for work in place. <br />Collova felt that at a minimum no building permits <br />should be issued until Class V is in place. <br />The City Engineer pointed out that the City will need <br />to protect the street based on weather conditions. If <br />there is frost in the ground, the Class V would need to <br />be protected. Therefore, the Engineer requested that <br />any issuance of a building permit for a model home be <br />conditioned upon City Engineer approval in order for <br />the street to be protected. <br />The City Administrator noted that the same situation <br />was addressed in the Frederickshaven plat, and the <br />development agreement can be amended to protect the <br />street. The Administrator stated that as far as <br />reducing the letter of credit for work in place, this <br />could be allowed as long as the City holds some <br />Page 10 <br />
