MINUTES <br />CITY COUNCIL <br />SEPTEMBER 9, 1992 <br />retainage so that if damages occur, the City has the <br />ability to make repairs, if necessary. <br />Von Reidel reported that Heritage Development will put <br />in sewer and water services to the three properties in <br />question at no charge. These property owners will be <br />responsible to connectinq these services to their <br />homes. Von Reidel expressed concern about the <br />improvement of Jackson Street from LaBore Road north. <br />Von Reidel pointed out that this section of street is <br />off their site and the improvement would benefit no one <br />other than the three properties adjacent. Von Reidel <br />stated that he did not believe Heritage should pay for <br />off-site improvements. If this is required, Von Reidel <br />requested that the City reduce park dedication fees so <br />that Heritage can recapture some of the costs. <br />The City Administrator pointed out that the City has no <br />way of recovering these costs pointing out that the <br />project is not being handled under a public improvement <br />process because of contracting issues and timing. <br />Collova felt this was a reconstruction project for this <br />section of road, and in other areas this type of <br />project would be assessed. <br />Von Reidel pointed out that a public improvement <br />process is lengthy, and since his contractors will be <br />mobilized, they could do the project along with the <br />Jackson Heights project and get it done with. <br />The City Administrator pointed out that the concern is <br />recovering costs, pointed out that this section of <br />street would not be improved if it were not for the <br />Jackson Heights project. <br />Council suggested that the City Administrator look at <br />alternatives for financing this section of road <br />improvement. <br />Von Reidel questioned the seven year length in item <br />#20, feeling that the City should know within two to <br />three years whether the street connection to the <br />industrial park is needed. <br />Collova agreed, and a three year time period was <br />suggested rather than seven. <br />Mr. LaValle introduced the following resolution and <br />moved its adoption: <br />Page 11 <br />
