The Administrator noted that the City has <br />allowed building permits for model homes under these <br />conditions in the past. <br />The City Engineer recommended that issuance of a <br />building permit for a model home be contingent upon <br />weather and street conditions. <br />The Administrator reported that item #11 addresses <br />grading and drainage. The Administrator reported that <br />it was thought that there was a 36-inch drainage pipe <br />in the area, however, the developer has found that <br />there is only a 18-inch pipe, which now necessitates <br />some on-site ponding. The developer is showing a <br />temporary pond in the area of the roadway connection to <br />the industrial park. The City Administrator <br />recommended that the developer be required to show an <br />alternative ponding site as well as escrow funds to <br />move the pond should the roadway connection be put <br />through. The Administrator stated that should the <br />roadway connection not go through, this is the best <br />area within the plat to provide on-site ponding. <br />The Administrator pointed out item #13, which requires <br />a letter of credit, amount to be determined by the City <br />Engineer. Item #14 involves the reconstruction of <br />Jackson Street from LaBore Road north with the <br />developer to pick up these costs. The Administrator <br />noted that without the project, the City would not have <br />proceeded with a road improvement project of this <br />degree in this area. Since the road improvement is <br />necessary because of the Jackson Heights project, it is <br />staff's recommendation that the developer be required <br />to pick up the costs. The Administrator stated that he <br />can see no basis for City taxpayers to pay this cost, <br />and we have not initiated 429 proceedings to allow the <br />assessment of these costs. <br />The Administrator reviewed item #15 which involves the <br />connection of 2902, 2884, and 2876 Jackson Street to <br />sewer and water. The Administrator reported that the <br />developer has acquired street right-of-way from 2884 <br />Jackson Street, and connection of this home to sewer <br />and water was a part of the purchase agreement. <br />However, the development agreement provides the that <br />developer show evidence of an agreement with the <br />property owners of 2902 and 2876 Jackson Street that <br />service will be provided. <br />The City Administrator reported that the developer of <br />the Jackson Heights project has indicated that the <br />terms and conditions of the development agreement <br />appear to be workable. The Administrator pointed out <br />item #21 which addresses berming. The Administrator <br />reported that it was his understanding that the berm <br />Page 9 <br />
