MINUTES <br />CITY COUNCIL <br />SEPTEMBER 23, 1992 <br />CHANGE-ORDER The City Engineer presented the Council a change-order <br />DESOTO STREET for the DeSoto Street improvement. This change-order <br /> involves removal and replacement of a fire hydrant in <br /> the amount of $1,433.26, patching of the bituminous <br /> base course for $4,882.31, and removal and replacement <br /> of existing storm sewer and catch basin on Leeward Way <br /> and extension of drain tile for $4,225.00. Total cost <br /> of the change order is $10,540.57. The Engineer <br /> reported that the City is at an impasse with the <br /> contractor on the issue of bituminous patching. The <br /> contractor will not enter the site until the patching <br /> is paid for. The Engineer reported that he is <br /> attempting to negotiate the patching cost downward. <br />The City Engineer explained that the base course of <br />bituminous was laid when the area was wet. Traffic was <br />them limited on the road until the area could go <br />through a freeze cycle. In the spring the paving <br />contractor for Pioneer Park parking lot used DeSoto for <br />access, and it is the DeSoto Street contractors <br />contention that this traffic caused the problems that <br />results in the need for patching. The Engineer stated <br />that it is difficult to prove damages in this <br />situation. <br />The City Administrator pointed out that the issue is <br />responsibility. There were no road restrictions in <br />place when the paving contractor used the street for <br />access. The Administrator stated that his contention <br />is that if the road was adequate, the City would not be <br />dealing with this issue. <br />Hanson asked about the cost for Leeward Way. <br />The City Administrator reported that the City has a <br />developer's deposit and a letter of credit to cover <br />this additional cost. <br />Mrs. Scalze introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 92-9-331 - APPROVING THE DESOTO STREET <br />CHANGE ORDER NO. 3 AS SUBMITTED BY THE CITY ENGINEER <br />SUBJECT TO THE APPROVAL OF THE CITY ADMINISTRATOR <br />The foregoing resolution was duly seconded by Blesener. <br />Ayes (5) Scalze, Blesener, Collova, Hanson, LaValle. <br />Nays (0). Resolution declared adopted. <br />REFINANCING Mary Ippel, Briggs and Morgan, appeared before the <br />BRECKENRIDGE Council requesting final approval of the refunding <br />PROJECT of $940,000 in commercial development revenue bonds for <br />Page 18 <br />
