MINUTES CITY COUNCIL NOVEMBER 18, 1992 Scalze pointed out that the point of the TIF was to make sure that these residentially-used properties could be purchased. Scalze felt that the parcels could still be developed commercially under the PUD. Crawford reported that it is very difficult to find a proposal that fits the site under the overall concept of the PUD. Crawford stated that from a practical standpoint, that option is not available. Hanson stated that the Council could provide no answers tonight, and suggested that because of the economy, perhaps the City should consider a rezoning of the area to commercial. Crawford asked if the Council was willing to use the excess TIF funds to acquire the Malsam property, or if the Council feels it must wait until there are enough funds to acquire all three of the parcels. Collova pointed out that the TIF District was created to take care of all three properties. Crawford stated that he would like to sit down with staff to explore options. Council was agreeable to this suggestion. RYAN The City Attorney requested a closed session following INDUSTRIAL the Council meeting to discuss pending litigation in PARK the Ryan Industrial Park road improvement matter. ROAD IMPROVEMENT Mr. Blesener introduced the following resolution and moved its adoption: RESOLUTION NO. 92-11-407 - AUTHORIZING A CLOSED SESSION FOLLOWING THE MEETING TO DISCUSS PENDING LITIGATION The foregoing resolution was duly seconded by LaValle. Ayes (5) Blesener, LaValle, Hanson, Scalze, Collova. Nays (O). Resolution declared adopted. CHANGE The City Engineer presented a change order for Imp. No. ORDER 92-5, LaBore Road. The change order involves a time IMP. 92-5 extension, elimination of a sewer lateral which was proposed to benefit a County road, which the County does not wish to pay for, and lowering of existing sewer and water services in the area. Net effect of the change order is a deduct of $4,659 in project costs. Page 7
