MINUTES <br />CITY COUNCIL <br />DECEMBER 15, 1992 <br />DeBace agreed, and pointed out that Bruhn would not <br />have enough frontage on the street to meet City minimum <br />requirements. DeBace also pointed out that Mr. Bruhn <br />has indicated that he did not want to be involved in <br />the project. <br />Blesener asked if Mr. Jespersen was aware of the <br />assessment reapportionment for the cost of the Costa <br />Lane stubs onto the Costa Estates Third Addition lots. <br />Mr. Jespersen replied that he was aware of this. <br />Hanson asked if Mr. Wright is aware of what is <br />happening. <br />DeBace reported that Mr. Wright is aware, and wishes to <br />be involved in the improvement of Costa Lane. <br />There was no one from the general public present <br />wishing to comment on this matter. <br />Upon motion by LaValle, seconded by Blesener, the <br />public hearing was closed. <br />Mr. LaValle introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 92-12-455 - APPROVING THE FINAL PLAT FOR <br />COSTA ESTATES TAIRD ADDITION SUBJECT TO THE PROPERTY <br />OWNER SIGNING WAIVERS OF RIGAT TO APPEAL ASSESSMENTS <br />FOR THE COSTA LANE IMPROVEMENT, AS WELL AS ASSUMING <br />RESPONSIBILITY FOR ASSESSMENTS CONTESTED BY DAVID <br />WRIGHT FOR HIS PROPERTY, SHOULD MR. WRIGHT REFUSE TO <br />SIGN A WAIVER OF RIGHT TO APPEAL <br />The foregoing resolution was duly seconded by Blesener. <br />Ayes (4) LaValle, Blesener, Hanson, Scalze. <br />Nays (0). Resolution declared adopted. <br />CUP Hanson opened the Public Hearing for consideration <br />MOGREN of an application for Conditional Use Permit submitted <br />PROPERTY by Robert Mogren to allow the accessory use of <br />industrial property without a principle structure on <br />the site. The property in question is located at the <br />northwest corner of Spruce Street and South Owasso <br />Blvd. The Planning Commission has recommended denial <br />of the request. <br />Mr. Mogren reported that the material stockpiled on the <br />site is peat or humus material. The material was very <br />wet and it takes a year of stockpiling on higher ground <br />before it is usable. It is now dried out and <br />Page 5 <br />
