MINUTES <br />CITY COUNCIL <br />FEBRUARY 24, 1993 <br />PROPERTY OWNERS AND HOLDING TAESE PETITIONS FOR FURTHER <br />ACTION <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (4) Pedersen, LaValle, Scalze, Morelan. <br />Nays (0). Resolution declared adopted. <br />PIONEER PARK Scalze noted receipt of a letter from Jim Olson, <br />CONCES5ION operator of the Pioneer Park concession stand lease <br />STAND requesting an amendment in the lease agreement for <br />LEASE 1993. Olson noted the limited profit that was made <br />during 1992 as well as his high overhead costs, and is <br />requesting that the rental fee for 1993 be waived. <br />Scalze noted the services that Olson provides at the <br />park while operating the concession stand which include <br />opening and closing building facilities and providinq <br />adult supervision. Scalze felt that the rent could be <br />waived qiven these other benefits that the City is <br />obtaining. 1992 rental amount was $470. <br />Pedersen asked if vandalism is an issue at the park <br />noting that it appears the building has received some <br />hard use. <br />Olson reported that close to all the vandalism that has <br />occurred at the building happened before the ballfields <br />became functional. <br />Scalze pointed out that Olson is also requesting that <br />the requirement that he provide Workers' Compensation <br />insurance be waived. <br />Olson pointed out that Workers' Compensation insurance <br />can be waived for a family-run business. Olson <br />reported that just he, his wife, and daughters work at <br />the concession stand. Olson pointed out that the <br />business has not had a hiqh volume and insurance is a <br />big cost. <br />The City Attorney stated that he would have to verify <br />whether the Law exempts the requirement of Workers' <br />Comp for a family business. If not, the insurance <br />coverage will have to be provided. <br />Olson pointed out that last year the weather was bad <br />and the volume of business at the concession stand was <br />low. Olson reported that he is requesting the waiver <br />of rent for the 1993 season only, and would be willing <br />to discuss the rent issue with the Council again next <br />year. <br />Mr. LaValle introduced the following resolution and <br />moved its adoption: <br />Page 17 <br />
