Resolution declared adopted.
PIONEER PARK Scalze noted receipt of a letter from Jim Olson,
CONCES5ION operator of the Pioneer Park concession stand lease
STAND requesting an amendment in the lease agreement for
LEASE 1993. Olson noted the limited profit that was made
during 1992 as well as his high overhead costs, and is
requesting that the rental fee for 1993 be waived.
Scalze noted the services that Olson provides at the
park while operating the concession stand which include
opening and closing building facilities and providinq
adult supervision. Scalze felt that the rent could be
waived qiven these other benefits that the City is
obtaining. 1992 rental amount was $470.
Pedersen asked if vandalism is an issue at the park
noting that it appears the building has received some
hard use.
Olson reported that close to all the vandalism that has
occurred at the building happened before the ballfields
became functional.
Scalze pointed out that Olson is also requesting that
the requirement that he provide Workers' Compensation
insurance be waived.
Olson pointed out that Workers' Compensation insurance
can be waived for a family-run business. Olson
reported that just he, his wife, and daughters work at
the concession stand. Olson pointed out that the
business has not had a hiqh volume and insurance is a
big cost.
The City Attorney stated that he would have to verify
whether the Law exempts the requirement of Workers'
Comp for a family business. If not, the insurance
coverage will have to be provided.
Olson pointed out that last year the weather was bad
and the volume of business at the concession stand was
low. Olson reported that he is requesting the waiver
of rent for the 1993 season only, and would be willing
to discuss the rent issue with the Council again next
year.
Mr. LaValle introduced the following resolution and
moved its adoption:
Page 17
