MINUTES <br />CITY COUNCIL <br />FEBRUARY 24, 1993 <br />The Planner again noted that if another vendor can meet <br />the requirements made of Linder's, that vendor would be <br />able to operate under the conditional use permit. The <br />Planner indicated that if problems occur, the City has <br />the authority to revoke the CUP. The Planner noted <br />that another vendor would have to meet the requirements <br />made of Linder's exactly, including size and dimension <br />of the mart and display area. <br />Pedersen asked how large the Linder's sign would be. <br />The Planner noted that he has not seen an application <br />for a sign permit as yet, and suggested that Linder's <br />contact the Building Inspector on this issue. <br />Morelan asked if the CUP would lock in use of the site, <br />or if a flea market, etc. could operate under the CUP. <br />The Planner replied that the CUP would be limited to <br />the flower mart type of operation as proposed by <br />Linder's. <br />The City Administrator asked about a fencing plan. <br />The Planner noted that fencing would be as shown in the <br />photographs submitted by Linder's, and that compliance <br />with the photos would be considered to be part of the <br />permit requirements. <br />The City Attorney recommended that the photographs be <br />made a part of the public record so that subsequent <br />applicants would have to comply with what is shown in <br />these photos. The Attorney indicated that the <br />ordinance provides for specifying a time limit for <br />reapplying or review of CUP's. Therefore, the Council <br />could require an annual review of the CUP. The <br />Attorney stated that the problem with revoking a CUP is <br />that the City must have legal reasons to do so. <br />There was no one from the general public present <br />wishing to comment on this matter. <br />Upon motion by LaValle, seconded by Morelan, the public <br />hearing was closed. <br />Mr. LaValle introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 93-2-46 - APPROVING THE CONDITIONAL USE <br />PERMIT TO ALLOW FOR TEMPORARY OUTDOOR SALES AND <br />DISPLAYS AT THE MARKET PLACE SHOPPING CENTER AT 2900 <br />RICE STREET AS REQUESTED BY LINDER'S GREENHOUSES <br />SUBJECT TO COMPLIANCE WITH THE RECOMMENDATIONS OF THE <br />Page 5 <br />
