ANALYSIS <br /> <br />As part of Staff’s preparations for the new City Administrator search, the City Clerk reviewed <br />City Code § 211 which provides the job description for the City Administrator. It was added to <br />the Code in 1989 and amended in 1995. The description no longer follows the actual duties and <br />responsibilities of the City Administrator. For example, it currently assumes the City <br />Administrator also performs the duties of the City Clerk and Treasurer. The City Administrator <br />should retain the Treasurer status for the City, but the City Clerk should be recognized as the <br />correct individual responsible for the clerk duties. <br /> <br />Under Minnesota Statutes, the City is required to designate a City Clerk and a Treasurer. The <br />City is a Plan A City under Minnesota law, which means that the City Clerk and Treasurer are <br />hired and fired by the City Council instead of being elected positions. <br /> <br />To better clarify the duties and responsibilities of the City Administrator, Treasurer and the City <br />Clerk, City Staff is proposing a repeal and replacement of City Code § 211 with a new ordinance <br />that would clearly define the City Clerk role and the City Administrator role. <br /> <br />In the new ordinance, the City Administrator will retain the Treasurer responsibilities. This does <br />not mean that the Finance Director does not oversee the City’s finance matters, but the City’s <br />budget and general finance should fall under the ultimate responsibility of the City <br />Administrator. <br /> <br />In the new ordinance, the City Clerk will assume responsibility for the clerk’s duties identified in <br />Minnesota Statutes. <br /> <br />II. <br />III. REQUESTED ACTION <br /> <br />City Staff is asking the Council to approve the repeal and replacement of City Code Section 211 <br />with the new ordinance as proposed by City Staff at the Council meeting. <br />
