MINUTE5 <br />CITY COUNCIL <br />APRIL 28, 1993 <br />Scalze felt the Gerten law office was a fine use for <br />the site, but pointed out that RB zoning would provide <br />protection for the City. <br />LaValle pointed out that the Gerten law office has been <br />in its present location for 27 years, and hopefully <br />will be in Little Canada for 15 to 20 years. LaValle <br />felt the proposal was a relatively simple one, and did <br />not believe the rezoning to B-3 would result in a <br />filling station locating on that particular corner. <br />Pedersen felt the rezoninq to RB was a good idea to <br />protect the City from what might happen in the future. <br />Mr. LaValle introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 93-4-102 - APPROVING THE PROPERTY <br />DIVISION AND RECOMBINATION OF PROPERTIES AS PROPOSED BY <br />MR. JOHN GERTEN FOR PROPERTY AT 303 EAST LITTLE CANADA <br />ROAD AS WELL AS APPROVING THE REZONING OF THIS SITE <br />FROM RESIDENTIAL (R-1) TO BUSINESS (B-3) <br />The foregoing resolution was duly seconded by Aanson. <br />Ayes (2) LaValle, Hanson. <br />Nays (3) Scalze, Morelan, Pedersen. Resolution denied. <br />Scalze recommended approval of the property division <br />and recombination of properties as proposed, rezoning <br />from R-1 to RB, waiving of Conditional Use Permit fee <br />for processing CUP application for office used under <br />the RB zoning, review by the County of the Little <br />Canada Road access asking for input on the best way to <br />handle that access, and review and approval of the City <br />Engineer of drainage of the site as well as subject to <br />dedication of the necessary drainage and utility <br />easements. <br />The City Attorney recommended that the property <br />division and the rezoning be handled as separate <br />actions. The Attorney again noted the rezoning to RB <br />rather than B-3 can proceed at the acquiescence of the <br />applicant. <br />Gerten pointed out that the CUP process will delay the <br />final action since the CUP will require another public <br />hearing. <br />Bob DeBace indicated that he spoke with the County on <br />the issue of access of the property, and the County <br />indicated that they will not make a recommendation on <br />the issue, but would react to a recommendation made by <br />the City. <br />Page 12 <br />
