MINUTES <br />CITY COUNCIL <br />APRIL 28, 1993 <br />Scalze asked about rezoning to B-2. <br />The Planner pointed out that B-2 zoning allows <br />auto-oriented uses. <br />Scalze pointed out to the applicant that the rezoning <br />to RB and resulting CUP application would not cost any <br />more since it is her recommendation that the City pick <br />up the cost of the CUP process in this case. <br />Gerten indicated that the RB zoning would be acceptable <br />if the City could guarantee that the CUP would be <br />approved. Gerten acknowledged that since the B-3 <br />rezoning failed approval by the Council, the RB zoning <br />would be acceptable. <br />Mrs. Scalze introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 93-4-103 - APPROVING THE PROPERTY <br />DIVISION AND RECOMBINATION OF PROPERTIES AS REQUESTED <br />BY MR. JOHN GERTEN FOR 303 EAST LITTLE CANADA ROAD <br />SUBJECT TO TAE COUNTY'S REVIEW OF THE ACCESSES PROPOSED <br />FOR THIS SITE, TO REVIEW AND APPROVAL OF TAE DRAINAGE <br />OF THE SITE BY THE CITY ENGINEER, AND TO THE <br />RECOMMENDATIONS OF THE CITY PLANNER AS CONTAINED IN HIS <br />REPORT DATED APRIL 5, 1993 <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (5) Scalze, LaValle, Hanson, Morelan, Pedersen. <br />Nays (0). Resolution declared adopted. <br />Mrs. Scalze introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 93-4-104 - APPROVING THE REZONING OF THE <br />PROPERTY DIVISION AND RECOMBINATION OF PROPERTIES AT <br />303 EAST LITTLE CANADA ROAD FROM R-1 (RESIDENTIAL) TO <br />RB (RESIDENTIAL-BUSINESS) AT THE ACQUIESCENCE OF THE <br />APPLICANT, MR. JOHN GERTEN, AND INSTRUCTING THE CITY <br />ATTORNEY TO PREPARE THE NECESSARY ZONING ORDINANCE <br />AMENDMENT, AND WAIVING ANY COSTS INCURRED BY THE <br />APPLICANT FOR PROCESSING HIS OFFICE USE PROPOSAL UNDER <br />THE CONDITIONAL USE PERMIT PROCESS <br />The foregoing resolution was duly seconded by Pedersen. <br />Ayes (4) Scalze, Pedersen, Morelan, LaValle. <br />Nays (1) Aanson. Resolution declared adopted. <br />Hanson reported that he opposed the resolution due to <br />the resulting lengthing of the timeframe for the <br />closing on the sale of the property. <br />Scalze pointed out that it is not the intention of the <br />Page 13 <br />
