MINUTES <br />CITY COUNCIL <br />APRIL 28, 1993 <br />Country Drive before they get to the recycling site. <br />Scalze felt that the question came down to the fact <br />that this is an illegal activity in the City, one that <br />is not allowed by the Zoning Code. The City entered <br />into an agreement with Frattalone in 1990 that the <br />recycling business would cease operation in 1992. <br />Scalze indicated that the City took Frattalone's word <br />that a building would be constructed on the site. <br />Scalze also pointed out that 2 or 3 months ago Mr. <br />Mogren came in and asked for approval to stockpile <br />materials on his vacant property. Scalze pointed out <br />that the Code does not allow this use without a <br />building on the site, the reason being that buildings <br />generate tax dollars which assist the City in funding <br />services. <br />Scalze pointed out that the City has a Community Pride <br />Committee which is comprised of inembers of the Chamber <br />of Commerce, business owners in Ryan Industrial Park, <br />members of the Planning Commission, City Council, and <br />City staff. This committee holds monthly meetings <br />discussing ways to upgrade the City, attract business <br />and increase the tax base. . <br />Scalze felt that if Frattalone wanted to conduct a <br />recycling operation, he should be requesting a Code <br />amendment to allow such an operation. Scalze pointed <br />out that the use Frattalone is putting the property to <br />is illegal under the Code, and his request to to <br />further increase that illegality. Scalze felt that <br />everyone in the City should be treated equally, <br />therefore, to continue the recycling use, the Code <br />would need to be amended, and if it were, other <br />property owners would be able to make the same request. <br />Frattalone questioned that his operation was illegal. <br />Frattalone reported that in 1984 he had a demolition <br />landfill permit for his site, and there was no <br />recycling operation being conducted. Frattalone <br />reported that when he started his recycling operation, <br />there was no law which stated that recycling was <br />illegal. Frattalone pointed out the public hearing <br />which was held to consider his recycling operation <br />noting that the City typically sends notices to <br />property owners within 350 feet of the property, but in <br />his case the City sent notices to property owners <br />within 1,000 feet. At that meeting there were only 1 <br />or 2 property owners opposed to the operation, <br />expressing concerns about dust. Frattalone reported <br />that since that time he has controlled the dust <br />problem.
