MINUTES <br />CITY COUNCIL <br />APRIL 28, 1993 <br />recycling operation as well as an extension to that <br />permit. Frattalone is requesting another extension at <br />this time. Frattalone indicated that his operation has <br />not been illegal and asked the City to show him a law <br />stating that it was illegal to recycle. <br />LaValle asked the Planner if the recycling operation <br />was a permitted use at that site. <br />The Planner replied that the Code requires a commercial <br />use to have a building of at least 1,000 square feet. <br />Scalze pointed out that in July of 1990 the minutes <br />reflect that Mr. Frattalone signed a development <br />agreement with the City that his recycling operation <br />would cease by July of 1992. At that time the <br />ordinance was also amended to exclude recycling <br />operations as permitted uses under the Code. <br />Frattalone pointed out that he had to sign the <br />development agreement, otherwise the City would not <br />allow his operation to continue. <br />Scalze pointed out that each city should take care of <br />its waste in a reasonable manner, and oities are <br />responsible for their own recycling, not being allowed <br />to recycling in another city. Scalze suggested that it <br />was not the responsibility of Little Canada to do <br />aggregate and bituminous recycling for the Metro area. <br />Scalze pointed out that no one else wants this use in <br />their city. <br />Scalze also pointed out that the issue is whether or <br />not this is a legal use in Little Canada, and if not, <br />Frattalone should be applying for an ordinance <br />amendment to make it a legal use. <br />Frattalone stated that his recycling operation is a <br />good business. Frattalone also indicated that he does <br />intend to develop this property, but pointed out that <br />there are currently enough empty buildings in the City. <br />Frattalone reported that he.is paying $16,000 in <br />property taxes for this site, and felt he must make <br />some use of the property. Frattalone pointed out that <br />the site is well-groomed and bermed. There is no sewer <br />to the property and no solution for Ryan Drive, making <br />the site difficult to develop. <br />Scalze pointed out that the City has worked with <br />representatives of Ryan Industrial Park Businessmen's <br />Association to work out a solution for the road <br />conditions. A road improvement is planned for the area <br />toward which the City will be contributing $50,000. <br />Page 19 <br />
