MINUTES <br />CITY COUNCIL <br />APRIL 28, 1993 <br />the present activity is allowed until July 31, 1993. <br />Therefore, a two week delay will not make a difference. <br />Mr. Pedersen introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 93-4-110 - TABLING ACTION ON TAE REQUEST <br />BY FRANK FRATTALONE FOR FIVE YEAR EXTENSION FOR HIS <br />BITUMINOUS RECYCLING OPERATING UNTIL THE MAY 12, 1993 <br />COUNCIL MEETING <br />The foregoing resolution was duly seconded by Sca12e. <br />Ayes (5) Pedersen, Scalze, Hanson, Morelan, LaValle. <br />Nays (0). Resolution declared adopted. <br />PIERCE Hanson reported and as a result of rezoning action by <br />PROPERTY the City on the back half of properties located on <br />COUNTY County Road C, there is a garage on the Pierce property <br />ROAD C at 77 West County Road C which would straddle the lot <br />line should the property be divided. Hanson suggested <br />that the City has created a hardship in this matter <br />since the property owner would need to remove the <br />garage in order to divide the property. <br />Mr. Don Pierce reported that the property in question <br />was owned by his mother, who recently passed away. Mr. <br />Pierce suggested that when the City rezoned the <br />property it did not take into consideration any <br />obstacles that would be in the way of the property line <br />location it created. Pierce reported that he tried in <br />vain to get the Council to address the situation at the <br />time of the rezoning. <br />Pierce also reported that at the time his mother's <br />property was assessed for the Rosewood Drive <br />improvement, he mother applied for and was granted a <br />deferment until such time as she would die or the <br />property would be sold. Pierce reported that he would <br />like to divide the property and dispose of it to his <br />children. However, he is faced with the problem of the <br />garage location and the assessments. The assessments <br />on the property now amount to approximately $15,000. <br />In addition to this cost, there will be the cost of <br />taking the building down as well as losing the storage <br />that building provides. Pierce asked the City what to <br />do about these problems. Pierce would like the matter <br />settled by June lst so that his son can homestead the <br />property. <br />Pedersen asked if this were the only garage on the <br />property. <br />Page 24 <br />
