MINUTES <br />CITY COUNCIL <br />APRIL 28, 1993 <br />Pierce replied that there is a garage with the house in <br />addition to the garage he is talking about. Pierce <br />reported that the entire site was zoned commercial <br />until the City rezoned the back portion abutting <br />Rosewood Drive. At the time of the rezoning, Pierce <br />felt that the City took nothing into consideration <br />about the property, and now he is left with the <br />problem. Pierce pointed out that the property cannot <br />be split without tearing down the garage. <br />Scalze pointed out that Pierce does not have to divide <br />the property. <br />Pierce stated that he must sell the property in order <br />to pay the assessments. <br />Morelan asked how far the garage was over the line. <br />Pierce estimated the garage was 6 to 10 feet over the <br />line. <br />Scalze pointed out that the property was rezoned <br />residential at the request of the Iona Lane residents <br />who wanted to see that adjacent property developed as <br />residential. <br />Pierce again stated that the City created the problem <br />by rezoning the property without looking at what <br />obstacles existed. <br />Scalze asked if Pierce wanted the City to take the <br />garage down. <br />Pierce replied that he would like the City to defer <br />some of the assessment to cover the cost of taking the <br />garage down. <br />Scalze pointed out that Tax Increment Financing <br />assistance was used for the Rosewood Drive project <br />which reduced the amount of the assessment to the <br />property owners. <br />The City Administrator pointed out that the City <br />assessed the cost of Rosewood Drive at about $13,000 <br />per lot when actual costs were higher. <br />Pierce reported that his mother's property is the only <br />one with an obstacle, therefore, he should receive some <br />compensation because of this hardship. <br />Hanson asked the City Attorney if the City had any <br />liability in this matter. <br />Page 25 <br />
