MINUTES <br />CITY COUNCIL <br />APRIL 28, 1993 <br />The City Attorney pointed out that the City is not <br />requiring that the property be divided, therefore, the <br />City had no liability as far as the location of the <br />building. <br />Pierce pointed out that the deferment papers his mother <br />signed indicated that the assessment had to be paid at <br />either the time of sale of the property or her death. <br />The City Administrator pointed out that a deferral of <br />special assessment does not require a property to be <br />divided, however, it was practical from Mr. Pierce's <br />standpoint to divide the property and sell a lot to pay <br />the assessment. The Administrator agreed that the <br />location of the garage was a hardship, and suqgested <br />that perhaps it was possible to remove the portion of <br />the garage which is over the lot line. The <br />Administrator suggested that while the qarage would <br />still not meet the required setbacks from the property <br />line, that situation could be addressed with a <br />variance. The Administrator suggested that the <br />variance process be provided to Mr. Pierce at no cost. <br />Pierce reported that he is talking about the cost of <br />removing the garaqe as well as what he is going to do <br />with the items stored in that garage. Pierce reported <br />that this was a burden on him, and he needs to make <br />some decisions. <br />Scalze stated that there are ways to remove a building, <br />however, the City cannot tell Pierce what to do with <br />the items stored inside that building. <br />Pierce felt that the City should pay the cost of <br />removing the garage, and that cost should be removed <br />from his assessment. Pierce suggested that if a <br />portion of the garage was removed, the City should pay <br />the cost of replacing that portion on the other side of <br />the structure away from the property line. <br />Pedersen asked if the structure had any value to the <br />commercial property should that property be sold for a <br />commercial use. <br />Pierce replied that it would depend on what the use <br />was. <br />Pedersen replied that it was his opinion that the <br />building was not worth a great deal. <br />Pierce felt it should be compensated for having to <br />split the building in half. <br />Page 26 <br />
