MINUTES <br />CITY COUNCIL <br />APRIL 28, 1993 <br />Gerten reported that he is proposing to have 11 parking <br />spaces on site, which is about 50% more than the Code <br />requires. <br />Scalze asked if there was someone living in the <br />westerly garage on the site. <br />Gerten replied that there was not, the garage is used <br />as a workshop. Gerten pointed out that he plans to <br />retain the westerly garage, but would be tearing down <br />the garage next to the house. <br />Aanson asked if the exterior of the house would be <br />remodeled to look like an office. <br />Gerten replied not at this time, reporting that the <br />property will cost between $15 and $16 per square foot, <br />which is 25% to 30% over market value. Gerten reported <br />that this is the maximum he can afford at this time. <br />However, the inside of the structure will be remodeled <br />for law office use, with three private offices, and a <br />reception area. <br />Scalze asked why the property was proposed to be <br />rezoned B-3 rather than RB or another zoning that would <br />not allow uses such as gas stations. <br />The Planner replied that an RB zoning was a <br />possibility, however, a law office would require a <br />Conditional Use Permit under the RB zoning. The <br />Planner reported that it was his opinion from comments <br />heard in the past that a zoning higher than B-1 was <br />preferred for the area. <br />Scalze stated that with a B-3 zoning if a property <br />owner wanted to put in a gas station, that property <br />owner would have some inherent rights. <br />The Planner replied that the City has the right to deny <br />a proposed use for the site if it is not compatible <br />with the area. <br />Scalze felt the law office use was a fine one for the <br />property, but she did not want to rezone the property <br />to a higher zone than was necessary to keep the use of <br />the property less intense given the traffic patterns in <br />the area. <br />The Mayor asked if there was anyone from the general <br />public present wishing to comment on this matter. <br />Calvin Poehls, representing the property owner to the <br />north, reported that they are not real pleased with the <br />Page 9 <br />
