STAFF REPORT <br />TO:Mayor Fischer and Members of City Council <br />FROM:Laura Linehan, Acting City Administrator <br />DATE:April 9, 2025 <br />RE:Resolution Authorizing Park View Court Association to Join the City of Little Canada’s <br />Organized Collection of Mixed Municipal Solid Waste and Recyclable Materials <br />ACTIONS TO BE CONSIDERED: <br />Council Consideration resolution authorizing Park View Court Association to join the City of Little <br />Canada’s organized collection of mixed municipal solid waste and recyclable materials. <br />BACKGROUND: <br />Chapter 809 – Solid Waste and Recycling <br />On February 8, 2024, the Planning Commission considered a text amendment to City Code Chapter <br />809 – Solid Waste and Recycling to specifically address modifications to accommodate new zoning <br />district categories for residential use. Additionally, the amendment also introduced an opt-in provision <br />for townhome developments to join the city’s organized collection contract for mixed municipal solid <br />waste and recyclable materials. As outlined in the amendment, existing townhome developments <br />would have the option to adhere to updated regulations voluntarily to the city’s organized collection, <br />whereas new townhome developments would automatically be part of organized collection. At the <br />Planning Commission, the amendment was recommended for approval to the City Council with an 8-0 <br />vote. <br />On February 14, 2024, the City Council considered Ordinance 891, Amending City Code Chapter 809 <br />– Solid Waste and Recycling to include a new exemption to service which outlines: <br />(4) An owner or resident of an existing residential property considered to be a medium-density <br />dwelling unit constructed before February 16, 2024, may continue to utilize their existing licensed <br />hauler provided there are no zoning code violations related to the collection of solid waste or <br />recyclable materials. Owners or residents of an existing residential property considered to be a <br />medium-density dwelling unit constructed before February 16, 2024, shall have the option to opt in to <br />receive service from a licensed hauler(s) who has a valid contract with the City. <br />Park View Court Association <br />In late January 2025, the city was contacted by Park View Court Association to inquire about the rates <br />and process for joining the city’s organized collection. After analysis, the Park View Court Association <br />HOA Board held a board meeting on January 28, 2025, and voted unanimously to join the city’s <br />organized collection based on rate information and provided minutes and a motion to support that <br />direction from the HOA. <br />Staff met with members of the Park View Court Association to discuss the additional steps to join the <br />city’s organized collection on February 24, 2025. At that meeting, city staff articulated needing to <br />work with the city’s legal team to ensure a proper process was followed, with a potential April 1 start <br />in conjunction with the city’s billing cycles. Park View Court also articulated a 60-day contract <br />notification clause.
