MINUTES <br />CITY COUNCIL <br />MAY 26, 1993 <br />at the Little Canada Road access, even though it might <br />be posted right turn in and out. <br />Hanson felt the traffic to the site would be very <br />limited. <br />Mr. LaValle introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 93-5-140 - APPROVING THE CONDITIONAL USE <br />PERMIT ALLOWING A PROFESSIONAL OFFICE USE IN RB ZONING <br />AT 303 EAST LITTLE CANADA ROAD FOR JOHN GERTEN <br />CONDITIONED THAT THE LITTLE CANADA ROAD CURB CUT BE <br />POSTED AS RIGAT TURN IN AND OUT ONLY, THAT THE <br />CENTERVILLE ROAD CURB CUT BE WIDENED TO 24 FEET TO MEET <br />MINIMUM CITY CODE REQUIREMENTS <br />The foregoing resolution was duly seconded by Pedersen. <br />Ayes (3) LaValle, Pedersen, Hanson. <br />Nays (2) Scalze, Morelan. Motion failed since a <br />Conditional Use Permit requires 4 affirmative votes of <br />the Council. <br />Scalze felt that the Council could not disregard the <br />recommendations of the Planning Commission and City <br />staff. Scalze did not believe it was out of line to <br />require an annual review of this CUP. <br />Morelan felt that any approval be conditioned upon <br />compliance with the recommendations of the Building <br />Official as outlined in his May 10th report. <br />Mrs. Scalze introduced the following resolution and <br />moved its adoption: <br />RESOLUTION N0. 93-5-141 - APPROVING THE CONDITIONAL USE <br />PERMIT ALLOWING A PROFESSIONAL OFFICE USE IN RB ZONING <br />AT 303 EAST LITTLE CANADA ROAD FOR JOHN GERTEN <br />CONDITIONED THAT THE LITTLE CANADA ROAD CURB CUT BE <br />POSTED AS RIGAT TURN IN AND OUT ONLY, THAT THE <br />CENTERVILLE ROAD CURB CUT BE WIDENED TO 24 FEET TO MEET <br />MINIMUM CITY CODE REQUIREMENTS, THAT THE <br />RECOMMENDATIONS OF THE BUILDING OFFICIAL AS LISTED IN <br />HIS MAY 10, 1993 REPORT BE COMPLIED WITH, AND SUBJECT <br />TO AN ANNUAL REVIEW OF THE CONDITIONAL USE PERMIT WITH <br />REGARD TO TRAFFIC CONDITIONS ASSOCIATED WITH THE LITTLE <br />CANADA ROAD CURB CUT <br />The foregoing resolution was duly seconded by Pedersen. <br />Ayes (5) Scalze, Pedersen, Hanson, Morelan, LaValle. <br />Nays (0). Resolution declared adopted. <br />Gerten pointed out that he has submitted a rear lot <br />line survey of the property, and asked if this would be <br />adequate since the Building Official is asking for a <br />property survey. <br />Page 8 <br />
