MINUTES <br />CITY COUNCIL <br />JUNE 8, 1993 <br />FRATTALONE The City Attorney reported that the Frattalone <br />DEVELOPMENT Development Agreement amendment has been submitted to <br />AGREEMENT Mr. Frattalone's attorney and the City is waiting for <br />comment at this time. <br />Mr. LaValle introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 93-6-168 - TABLING ACTION ON THE <br />FRATTALONE DEVELOPMENT AGREEMENT UNTIL THE JUNE 23RD <br />REGULAR COUNCIL MEETING <br />The foregoing resolution was duly seconded by Pedersen. <br />Ayes (5) LaValle, Pedersen, Aanson, Scalze, Morelan. <br />Nays (0). Resolution declared adopted. <br />RYAN The City Attorney reviewed the documents that are a <br />INDUSTRIAL part of the Ryan Industrial Park Improvement. The <br />PARK first document is the Declaration of Covenants in which <br />IMPROVEMENT the various property owners are agreeing to have <br />DOCUMENTS recorded on their Certificates of Title a statement <br /> that the project is not up to City standards and a list <br /> of the deficiencies of the project, soils, etc. so that <br /> subsequent owners of the property will be provided <br /> notice of the type of roads in the area. The second <br /> document is an Agreement by which Mr. Ryan and the <br /> various property owners are releasing each other of any <br /> liability for problems relating to the project. This <br /> document will not be recorded, but incorporates the <br /> other documents as a package. The Attorney pointed out <br /> that the project is dependent on the numbers coming <br /> back in the appropriate range. Also, Mr. Ryan's <br /> attorney has indicated that neither he nor Mr. Ryan has <br /> any objection to the documents. <br /> The City Administrator asked if the Council has any <br /> concern with the content of these documents pointing <br /> out that the City will obtain signatures on these <br /> documents prior to awarding a contract. <br /> Morelan asked the fundinq source for the project. <br />The City Administrator replied that the project has <br />been included in the bond issue for the 1993 <br />improvement projects. 20% of the costs, up to $50,000 <br />(which is the City's share of the project cost) would <br />come from a combination of the Street Overlay Fund, MSA <br />Funds, and the Closed Bond Fund. <br />Morelan pointed out that he is aware that at least one <br />property owner would like to handle the project <br />differently, and asked if the project as proposed was <br />determined to be the best way to go. <br />Paqe 14 <br />
