Chazin pointed out that the sign is in <br />compliance with the Code. <br />Scalze indicated that the sign is in compliance because <br />there is a building on the property. The Planner <br />pointed out that the Code requires that a sign be <br />associated with an established business. However, a <br />shopping center would be allowed a second pylon sign by <br />Conditional Use Permit. <br />Chazin reported that should the Burger King building be <br />removed and The Market Place Shopping Center desire a <br />second pylon, they would make application for a CUP. <br />LaValle indicated that if the Burger King building is <br />removed, The Market Place Shopping Center should be <br />given an opportunity to apply for a CUP to retain the <br />sign. <br />Mr. LaValle introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 93-8-262 - APPROVING A CONDITIONAL USE <br />PERMIT TO AMEND A PUD ALLOWING FOR TAE RELOCATION OF AN <br />EXISTING DRIVEWAY AT THE MARKET PLACE SHOPPING CENTER <br />SUBJECT TO APPROVAL BY TIIE CITY PLANNER OF A <br />LANDSCAPING AND SCREENING PLAN, WITH MR. GENE DELONAIS <br />TO BE KEPT INFORMED OF THESE DETAILS~ AND SUBJECT TO <br />APPROVAL BY MN DOT AND THE CITY ENGINEER RELATIVE TO <br />SAFETY ISSUES FOR THE ACCESS ON RICE STREET <br />The foregoing resolution was duly seconded by Scalze. <br />Ayes (5) LaValle, Scalze, Hanson, Pedersen, Morelan. <br />Nays (0). Resolution declared adopted. <br />CUP FOR Hanson opened the public hearing to consider an <br />ACCESSORY application for a Conditional Use Permit to construct <br />GARAGE an accessory building (garage) larger than 1,000 <br />JOHN SCqI.LEY square feet as well as a fill permit application <br />submitted by Mr. John Sculley for property located at <br />3000 LaBore Road. The Planning Commission recommended <br />approval of the request. <br />John Sculley appeared before the Council reporting that <br />he would like to construct a garage closer to his <br />house. Sculley reported that he has several cars and <br />other equipment and tools which would be stored in the <br />garage. Sculley further reported that eventually he <br />would like to divide 2.3 acres from his mother's 26 <br />acre site.
