MINU'PES
CITY COUNCIL
AUGUST 25, 1993
Scalze pointed out the Planning Commission's
recommendation that the old barn on the property be
removed by August of 1994.
Sculley indicated that he was agreeable to that
condition. Sculley also indicated that the garage
would be located 30 to 33 feet immediately south of the
house. The carport would remain.
Scalze pointed out that at the time the property was
subdivided in 1980, the City required that a 60-foot
road easement be dedicated to provide access to the
site from Beam Avenue. That road dedication was never
made, and Scalze believed it should be addressed at
this time.
Sculley indicated that the City would have to discuss
this issue with his mother or her attorney, and could
not understand how this slipped by.
Morelan pointed out that the City has the opportunity
to address this issue as part of the CUP.
There was no one present from the general public
wishing to comment on this matter.
Upon motion be LaValle, seconded by Pedersen, the
public hearing was closed.
The City Administrator reported that Mrs. Sculley's
attorney contacted him this afternoon and reported that
he could not find that the road dedication transaction
was ever completed.
Morelan felt it should be a condition of the CUP
approval.
Sculley pointed out that his parents had no objection
to the dedication at the time the property division was
approved. The survey work was completed, and Sculley
was not sure how the issue slipped by.
Mr. LaValle introduced the following resolution and
moved its adoption:
RESOLUTION NO. 93-8-263 - APPROVING THE CONDITIONAL USE
PERMIT TO CONSTRUCT AN ACCESSORY BUILDING (GARAGE)
LARGER THAN 1,000 SQUARE FEET IN SIZE AS WELL AS FILL
PERMIT AS REQUESTED BY MR. JOHN SCULLEY FOR PROPERTY
LOCATED AT 3000 LABORE ROAD SUBJECT TO DEDICATION OF
60-FOOT ROAD EASEMENT AND SUBJECT TO THE
RECOMMENDATIONS OF THE PLANNING COMMISSION
Page 15
