MINU'PES <br />CITY COUNCIL <br />AUGUST 25, 1993 <br />Scalze pointed out the Planning Commission's <br />recommendation that the old barn on the property be <br />removed by August of 1994. <br />Sculley indicated that he was agreeable to that <br />condition. Sculley also indicated that the garage <br />would be located 30 to 33 feet immediately south of the <br />house. The carport would remain. <br />Scalze pointed out that at the time the property was <br />subdivided in 1980, the City required that a 60-foot <br />road easement be dedicated to provide access to the <br />site from Beam Avenue. That road dedication was never <br />made, and Scalze believed it should be addressed at <br />this time. <br />Sculley indicated that the City would have to discuss <br />this issue with his mother or her attorney, and could <br />not understand how this slipped by. <br />Morelan pointed out that the City has the opportunity <br />to address this issue as part of the CUP. <br />There was no one present from the general public <br />wishing to comment on this matter. <br />Upon motion be LaValle, seconded by Pedersen, the <br />public hearing was closed. <br />The City Administrator reported that Mrs. Sculley's <br />attorney contacted him this afternoon and reported that <br />he could not find that the road dedication transaction <br />was ever completed. <br />Morelan felt it should be a condition of the CUP <br />approval. <br />Sculley pointed out that his parents had no objection <br />to the dedication at the time the property division was <br />approved. The survey work was completed, and Sculley <br />was not sure how the issue slipped by. <br />Mr. LaValle introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 93-8-263 - APPROVING THE CONDITIONAL USE <br />PERMIT TO CONSTRUCT AN ACCESSORY BUILDING (GARAGE) <br />LARGER THAN 1,000 SQUARE FEET IN SIZE AS WELL AS FILL <br />PERMIT AS REQUESTED BY MR. JOHN SCULLEY FOR PROPERTY <br />LOCATED AT 3000 LABORE ROAD SUBJECT TO DEDICATION OF <br />60-FOOT ROAD EASEMENT AND SUBJECT TO THE <br />RECOMMENDATIONS OF THE PLANNING COMMISSION <br />Page 15 <br />
