MINOTES <br />CITY COUNCIL <br />AUGUST 25, 1993 <br />PROPERTY The Council reviewed the request of Mr. Engebretson for <br />DIVISION the division of his property located at 154 Old County <br />F.NGEBRETSON Road C into two lots. The Planning Commission <br />recommended approval subject to the recommendations of <br />the City Planner as outlined in his report dated August <br />6, 1993 with the exception of the recommendation for <br />removal of the lean-to on the existing garage. <br />Morelan reported that he looked at the area, and there <br />is a section of unimproved street adjacent to the <br />lean-to. <br />The City Administrator reported that the unimproved <br />street does not extend as far north as the lean-to. <br />Scalze felt that the City should require removal of the <br />lean-to since the requirement for a house on the new <br />lot would be a 30-foot setback from the dedicated <br />street right-of-way. Scalze did not believe the <br />lean-to should have more rights than the new house <br />would. <br />Morelan pointed out that the lean-to is a long way from <br />the paved road surface, while a new house would be <br />fronting on the street. Morelan did not believe this <br />was a situation were the letter of the ordinance should <br />be adhered to. Morelan also pointed out that the <br />lean-to cannot be moved to the north side of the garage <br />as recommended by the City Planner, since this is where <br />the garage doors are located. Morelan stated that he <br />assumed the lean-to was in conformance with the <br />Ordinance at the time it was constructed. <br />The City Planner indicated that it has been the City's <br />practice in the past to require that setback violations <br />are cleaned up when a request for a lot split is made. <br />Requiring removal or relocation of the lean-to would be <br />consistent with past actions. <br />Aanson pointed out that there is no dedicated easement <br />for Lakeshore Avenue from the cul-de-sac to the north <br />or from County Road C to the south. <br />Pedersen commented that the lack of this dedicated <br />easement makes it questionable whether the Engebretson <br />property is a corner lot. <br />Mrs. Scalze introduced the following resolution and <br />moved its adoption: <br />Page 9 <br />
