MINUTES <br />CITY COUNCIL <br />SEPTEMBER 22, 1993 <br />would be concerned about control issues. Vitale also <br />pointed out that Gordies would have a difficult time <br />channeling volleyball participants through their <br />building. <br />Scalze stated that the reason for this is the lack of <br />fencing, and suggested that the area could be fenced to <br />direct volleyball participants through the building. <br />Scalze indicated that she wanted the City to be <br />prepared for the outdoor sale and consumption issue <br />when the Hoggsbreath comes in to make application for <br />their volleyball court. Scalze pointed out that there <br />are a lot of mobilehome residents adjacent to the <br />Hoggsbreath who may be affected by outdoor volleyball. <br />LaValle felt that the liquor license holders in the <br />City should be asked to comment on the issue. <br />Scalze suggested that surrounding property owners be <br />asked to comment as well. <br />LaValle pointed out that the City has had no complaints <br />about outdoor sales and consumption. The public <br />hearing on the Gordies conditional use permit did <br />generate some complaints, but they were not related to <br />alcohol consumption. <br />Morelan indicated that he was in favor of being <br />pro-active, but indicated that regulating outdoor <br />liquor sales and consumption may be overkill. <br />Scalze suggested that the issue be tabled for six <br />weeks. Scalze indicated that it does not seem right to <br />her that people patronizing a liquor establishment in <br />the City are allowed to drink right up to the curb. <br />LaValle indicated that State Law prohibits taking <br />alcohol off the premises. <br />Vitale assumed that drinking was only allowed in the <br />on-sale liquor business building. <br />Scalze indicated that this is not what the City <br />Attorney has said. <br />The City Attorney reported that the City's ordinance <br />identifies an on-sale liquor establishment as the <br />premises of that business. The premises include the <br />described area on the permit. <br />The City Administrator pointed out that for the outdoor <br />events at the Venetian, and for the volleyball court at <br />Gordies, the City has required that site plans be <br />submitted. <br />Page 23 <br />
